He wasn't an alcoholic when I fist started dating him. I broke up with him web he started drinking and that's when the fight happened and he started hitting me. I finally got out of the situation but I'm scared that he's still looking for me. He's still calling me and stuff but I'm at a friends house so he can't find me. I just want to feel safe.

I have too much respect for myself. Who would want to be with someone who lays their hand on their girlfriend. If he does it once I'm sure he'll do it again. I just want to feel safe when I go home and I need some advice on what I should do since fairfax county isn't doing much to help.

I don't know how much they can do. But if nothing else they can probably provide advice on how to keep yourself safe.

Well, I did start pulling away from him and ignoring him when I noticed he was drinking a lot. The day I told him that it was over was when he hit me. He's never done it before that day

So why wasn't it domestic violence? Usually that would be a given in a boyfriend/girlfriend fight, What else was going on? Are you also business partners or something? Does the guy go around punching out everybody? And theoretically a protective order is available to anybody who is being threatened by anybody. Something's missing here.

I have doubts about the op story. They're are countless of stories about how FFX police charges people in Domestic Violence cases...

A friend of mine was wrongfully accused (he was actually a victim due to some bullshit "he doesn't raise his hand to females" rhetoric ..

He himself had a black swollen eye and other injuries and she (so called "victim) had injuries that were consistent with her striking him only.

He got arrested, charge and thrown under the bus..

i dont buy your story for a second. its not a domestic assault since its not a covered relationship. that means its a simple assault. if you "really" went to the magistrate and told him what happened, then he would have issued an assault warrant against him. that is if your story was credible. you cant just go to a magistrate and expect to get a protective order but not press charges for the assault. it doesnt work that way. oh, by the way, a protective order is just a piece of paper. hold it up when he tries to hit you next time and see if it helps. like i said, if you really went to a magistrate, then an assault warrant would have been issued, so my guess is you chickened out and didnt press charges because you love him, and you cant help yourself. then blame the cops for not helping you, when in fact they did help you. cops cant arrest someone for a simple assault w/o a warrant unless they actually witness it. thats why you had to get your own warrant. so next time, help yourselve and stop bitching about everyone else when its not their fault.

While I like your post you did get one thing wrong. Under VA law, cops can arrest you for an assault without a warrant even if they did not witness it. Most cops will not do it and will tell people to go get warrant from magistrate.

It is a misd. That occurred without law enforcement present at the time. She does need to go to a magistrate for that particular offense.

May I suggest you go read some Virginia Law. Try code section 19.2-81. Pay attention while reading section G. Assault is one of the few charges that is a misdemeanor that police can arrest you for even if they did not witness it.

For all the posters that claimed this was domestic violence, again read VA code 18.2-57.2. A boyfriend punching his girlfriend is not domestic assault under Virginia law UNLESS they have a child in common or they have lived together in the past 12 months.

Also remember that the police can arrest if a magistrate has issued an arrest warrant whether the police witnessed the crime or not.

let me rephrase my earlier post. yes they can arrest for simple assault. no cop in this area will unless the person assaulted wishes to press charges, and the assaulter has no id or fixed address that cant be verified. no cop around here will arrest for simple assault they did not witness unless its under those circumstances. regardless as I stated before, she should of got her own warrant. if the magistrate denied her alledged assault warrant, then she was not a convincing victim to the magistrate.

@BillN, you are correct. Any idiot knows a cop can make an arrest when there is a warrant. My post dealt with warrantless arrests, keyword LESS, meaning there is no warrant. I never stated they could not do that, but obviously she couldnt convince the magistrate to issue a warrant much less a preliminary protective order, and thats why she is complaining instead of blaming herself.
