New VA Law: Text/GPS Use = Reckless Driving

Here is the wording of the new law being proposed for Virginia in 2013. Primary author is Rob Bell, candidate for Attorney General.


ยง 46.2-853. Driving vehicle that is not under control.

A person shall be guilty of reckless driving who drives a vehicle that is not under proper control or that has inadequate or improperly adjusted brakes on any highway in the Commonwealth.

"Driving a motor vehicle that is not under proper control" includes driving a motor vehicle on any highway in the Commonwealth while simultaneously using a handheld personal communications device for any purpose other than verbal communication.

I will never understand why the legislature (both Federal and local) is always chasing after things well beyond the point of them being a menace in order to get laws in place that address matters of public safety.

When I was growing up, my Grandfather never had a radio in his car. When I asked him about it one day, he got a very serious look on his face and said, "My brother...your Great Uncle was killed by another motorist who plowed into him at a stopsign from behind because she was fiddling with the radio. Radios are fine, but they have no place in automobiles." This was 40 years ago.

I remember in the mid-90's when I saw my first person driving and talking on one of those cellular bag phones weaving all over the damn road and thinking, "Wow...that's fucking dangerous..."

Texting has been around more than 10 years now and here we are finally scratching the surface on getting our arms around this. The #1 lobby in this country...the gun lobby. The #2 lobby in this country...the cell phone lobby. If we get laws in place nationally that ban cell phone use while driving a motor vehicle hell...cell phone revenue will drop 30+%. The cell phone industry doesn't want ANYTHING in place that would restrict use of their prouct and thus decrease revenues. Instead of lobbying for loose cell phone usage restrictions...why don't they get with the autmobile manufacturers and get funding behind the autonomous car. Then people people can talk safely while they drive....errr, "ride".

Please ban talking on cell phones too! I'm so freaking tired of people driving 30 mph under the speed limit because their phone conversation is soooooo enthralling.

Oh and daily some jackass at a traffic light doesn't go because their checking their Facebook status.

The state should just allow other drivers to beat cell phone talkers/texters senseless and run their car into a ditch.

If I could run them off the road I would but in lieu of that the high beams and horn blasting from an F250 riding their ass tends to help drive those points home. lol

I always lay on the horn when I pass or am stuck behind someone on a cell phone.

I figure if everyone honks at drivers on their phones, the people they're talking to will eventually get the impression that the driver is an idiot who is annoying other drivers.
