Verizon "Notice of Claim of Copyright Infringement"
Posted by: downloader ()
Date: August 06, 2012 02:07AM

I received an e-mail from Verizon stating that a "copyright owner" notified them that I have illegally downloaded a song from a p2p file sharing program (Ares).

The violation notice concerns only one song. Admittedly, I do my fair share of downloading torrents and movies- I was shocked to see it was for some random song I downloaded a year ago, and not a whole album torrent.

Is this anything to worry about?

Thanks for any help....

The E-mail is below.

Dear Verizon Online Customer:

We are writing to advise you that Verizon recently received a notification from a copyright owner of a possible copyright violation that appears to involve your Verizon Online account (the "Complaint"). The work(s) identified by the copyright owner in its Complaint are listed below.

We are contacting you because our records indicate that the Internet protocol (IP) address provided to us by the copyright owner was assigned to your service on the date and time identified by the copyright owner. While this activity may have occurred without your permission or knowledge by an unauthorized user, or perhaps by a minor who may not fully understand the copyright laws, as the primary account holder, you are legally responsible for all activity originating from your account.

Copyright work(s) identified in the Complaint:

Copyright infringement level: 1
Notice ID: XXXXXXXXXXX
Title: THE WAITING
Protocol: P2P
IP Address: XXXXXXXXXX
DNS:
File Name: tom petty- the waiting(2).mp3
File Size: 3036372
Timestamp: 08-02-2012 02:03:40 UTC

Copyright infringement is a serious matter that violates U.S. copyright law and subjects infringers to criminal and civil liability. It also violates our Acceptable Use Policy (http://www2.verizon.net/policies/acceptable_use.asp) and Terms of Service (http://www2.verizon.net/policies/tos.asp). If you, or someone using your Internet connection, are engaged in the conduct alleged by the copyright owner, we urge you to stop (and ensure that anyone else who might have access to your Internet connection also stops).

Protecting Your Privacy: The copyright owner has not asked Verizon to identify you, and Verizon will NOT provide your identity without a lawful subpoena or other lawful process. However, if the copyright owner does issue a lawful subpoena or other lawful process that seeks information about your identity or account, Verizon will be legally required to provide the requested information to the copyright owner.

We appreciate your cooperation on this matter.

Sincerely,

Verizon Online

It's likely a copyright troll that has captured the logs from where you pulled the song. See below. Search and you'll find more on how the scam works.

1. Don't respond.
2. Don't share for a few months.
3. Frame the letter.
4. Profit.

You're showing your age with that song title.

If MTV or VH1 actually played music videos, there wouldn't be all this downloading.

Buy the CD, scratch it, and tell the Copyright people. My CD is scratched, send me a new one, or give me a way to replace it.

The problem comes in when you SHARING the song, and that works by default with torrents. Best thing is download and remove after it's done.

One Warren 'Shabazz' Burris is Verizon's head of customer service. Check him out on this website:

http://www.pbsgamma.org/1980s.html

And you wonder why Verizon sucks? They hire people like this.

Tell them it was an honest mistake. You were looking for the latest musical stylings of Susan Mitchell Petty and the download site screwed up.

What do I need to do......?

I uninstalled my p2p program (Ares)....
Do I need to delete my songs off my computer? Will that help? Or is the damage already done?

Is this really anything to even worry about?

Please, serious feedback.

Thanks.

Verizon sent out a letter stating June 4th it would start tracking that stuff. My friend borrowed my laptop and had it out in CO when he got that same message from Cox, but it was for the whole house, they did exactly what you did, nothing ever happened.

I've continued to download, I just remove the torrents when they finish(sorry) and don't seed. I have yet to get anything like that *knock on wood*

I'd burn the songs to CD, clear them off your computer, then import them back off the CD if you're really worried. I'm just trying to burn and delete everything I download now, although that's in part cause I'm outta space! Damn lil laptops!

A year ago, huh?? Why even lie about when it happened? I know for a fact that the timestamp doesn't lie and is correct down to the very second that the file was downloaded as I have recieved 2 of these types of emails in the past for copyright infringement.

**I never actually committed any type of copyright infringement and recommend everyone else follow the copyright laws as well**

@Jive..... the timestamp refers to the Date and Time the Copyright owner notified verizon...NOT when I downloaded the file.

From the Email....

"We are contacting you because our records indicate that the Internet protocol (IP) address provided to us by the copyright owner was assigned to your service on the date and time identified by the copyright owner."

99.999999% that this is the last you're going to hear about it. Just be careful and don't download any stuff for awhile. Otherwise, don't worry about it.

I just used iptracker.org because i want to know who is breaking into my wireless. I have it as secure as i know how. Hidden network, password is at least 17 letters with caps and letters on wifi router.

that was IP address listed in my email from verizon. 96.244.243.221 also, crazy thing is that my power went out thursday at 3 am and my computer stayed off the rest of the day, so how did someone download a song from a computer that was turned off?

date code was 02-27-2013 at 17:26:16 UTC

Assuming someone is using your wireless, they aren't using your PC, they are using their PC connected to your wireless. They just need your wireless network and modem to be working, not your PC. You can probably restrict your wireless to specific MAC addresses to tighten it up further.

How is that going to tighten it up when someone could easily spoof your MAC?
