As mentioned, the original contest change was very "time-sensitive". Which we all thought meant that Amazon had contacted them to remove their affiliation with the show's contest. Unusual though, because reading through similar discussions on the Amazon affiliate forum, they are quick to pull everything with no warning for that type of offense. So, more likely, someone had read here that it was being reported, told Oscar before the show, then he had an intern research the subject. Most likely those same discussions were found quickly and that caused the mid-show destruction of the show lottery.

However, both current attacks are very valid, the No Purchase required argument should cause them to have to describe a way to enter without costing any money, it would also be interesting to find out how they will be randomizing their winners, since, from their description, it seems they will be picking whoever they want to win (illegal). Reporting it to Amazon, citing the original infraction, will probably end up losing them that affiliation. I did notice they followed the rules as far as not using any part of the Amazon logo, but if it had been me, I would have not even mentioned them by name, especially if an Amazon C&D was the reason for the original change.

Unless the wording of this has been run past both Mike's and Amazon's Legal Console...... Which I'm sure happened.

Just to clarify for any Klubbers late to the party, the TMOS MVP contest was (when it was based on amazon purchases) and still is (based on Bone-Us show purchases) an illegal lottery. At a very basic level, rules governing this type of thing vary widely from state to state and country to country. By not even stating where the contest is valid, they're running an illegal international lottery. In the US at least, whether it's a legal sweepstakes or an illegal lottery comes down to three factors; chance, prize and consideration. If it meets all three, it's illegal. They are even more vague with the latest version of the "rules", there is no explicit mention of a random draw, but if it's not random, that's ok. When Tripp, Tabb, Todd Hess and Mike's two daughters get gift cards, you have nothing to complain about. If there is the appearance of a random draw, that's the chance portion. Prize is a given, there are 4 or 5 $250 Amazon (again with the amazon, begging for a strike two) gift cards to be won. Consideration is where there is a real problem. If you go with the poorly worded and legally pathetic cut-and-paste rules, you don't have to purchase anything to win. That goes against the rest of the wording on the page and everything that has been said on the show. If you have to purchase a yearly bonus package (may god have mercy on your soul), it's clearly true that you are providing the promoter a consideration (ironically a phrase Fatt Rob and LFF use from time to time) in order to enter the contest. Boom-Bamm, illegal lottery. Maybe LOLscar will go to law school after he gets that MBA and they can kick their existing Legal Console (google it) to the curb.

I'm actually looking forward to the result of all of this. It was Oscar's idea in the first place, so a second strike should be enough of a reason for Full Mike, especially if he and Carla get their drinky drink on before seeing the klub thread. "See Carla, he's trying to screw me again! You need to come on the show tomorrow to straighten him out." Hopefully it won't boil over until Patton is in studio though.

There is a big difference between this "contest" and the thing BOAD did last year, everyone that bought a yearly got a thank you gift, then there were a few large prizes. I'm sure Mike and Rob fought the gift idea, but that's really what changes a lottery into an incentive to buy.
