Drinking and driving

Lets face facts. Everyone drinks and drives. EVERYONE drinks and drives ALL the time.

So remember that thing that guy told you where if you are driving drunk (and if you're driving, you're going to be drunk cause everyone drinks and drives).... and if you get pulled over by a cop you could get out of the car, put your keys on the roof and chug a bottle of vodka in front of the cop and that way he couldn't prove that you were driving drunk...

Remember that? Is drunk in public (far better than a DUI) the only charge a cop could really give you? Or could they slap you with some other bullshit.

Doesn't everyone have a story about someone they know did that but you think they're full of shit cause nobody is prepared for it or even has the balls to do it?

Never heard of anyone actually doing the - get pulled over and chug alcohol to beat a DUI. This is how Id realistically see it going down:

You pull over to the side of the road, immediately get out with something in your hand (vodka bottle)

Cop rushes up shouting some kind of orders at you, while you continue to chug.

You get tasered or something.

You get arrested for DUI, obstruction of justice, resisting arrest.

I don't think it would work, they'd still arrest you for the DUI and let the courts sort it out. The probable cause for arrest still exists.

I doubt you would get tasered if you weren't posing a threat to the cop. That would take a real asshole cop to do that, and with the dashboard cams nowadays I don't think a cop would want to risk a suspension for unnecessary force.

Obstruction of justice... maybe, but I wouldn't think so. Obstruction would imply a presumption of guilt. Since the cop would not be able to prove that you were driving drunk, he could not prove that you are interfering with a police investigation.

Resisting arrest... maybe, but again I don't think there would be sufficient evidence to prosecute you.

Either way, the goal is to receive a lesser charge than a DUI.

Great idea, the cop stops you and you reach under the seat to pull out your handy bottle to take a hit from. Cop blows your head off assuming you are reaching for a gun. Instant wormfood.
