The attorney said that Cary's posting of individuals arrest history after the charges have been dismissed or legally expunged by court order is illegal, indirect violation of court orders, and could result in the shut down of this site if not corrected.

Why would someone want to post their arrest record; especially, if the person was acquitted or any wrong doing. What if a person wants to run for say governor of NY?

Even if you were wrongfully arrested and later acquitted I want that information to be public. Because you're probably still a sketchy mother fucker, and I need to know about you, and where you live, and all your nasty little habits - to keep my family safe!

In response to both vigilant ffx mom and Meeper...With all due respect, you are both incorrect. Cary, I have given you my contact info.

I was arrested because I tried to take my neighborhood back from a punk that was selling drugs out of his 3 doors up from me & my young family. All hours of the night people would race up & down the street after they made their purchase. No one wanted to get involved because they were all afraid. I got tired of hearing crap like they could be in a gang!!! One night I confronted the sellers.

At the time of my incident this guy and his friend were out on probation for selling drugs. The night I was arrested for getting into a conflict with them, they were charged with possession of a large quantiy of pot and DWI.

My charge was dropped and my arrested was ordered expunged.

I was surprised when a friend told me they saw my name on this site.

The attorney that handled my case is quite competent. Yes, I am sure he would like to make more money. Who doesn't.

I can walk away or I can spend hard earned money out of principle to have my name removed from this site.

To be honest, I thought once Meeper/Cary heard the facts it would be a quick/easy thing to remedy. Guess I was wrong and didn't understand whom I am dealing with.

I'm just glad I wasn't lumped in as a regular or an alias for Cary. He got it all wrong!!!

If the Fairfax police wanted the public record expunged, they would publish "correction" or "remove" records along with the new records so they could be removed from public databases that use this info.

You should sue the FCPD before you sue Cary... they publish this stuff every week and after they do so it is public record.

Interesting little thread. As a clerk at the court house I know several attorney & judges. Slandered is correct.

Depending upon the charge and facts of the case everything can be erased, including the arrest. It’s as if it never happened.

It sounds like ffx underground searched the public arrest history prior to this guy’s expungement order and has never removed the data from the site. A new search of the public arrest history data base should find nothing (if it was truly expunged).

Seems to me newspapers run arrest records all of the time. You mean they are breaking the law too?

Of course... if they don't run a detraction, which by the way is never published by the police in the same form as the arrest records update, why not? Just post to some forum that you are a "lawyer" or a "court clerk" and spout your opinion.

I'm no lawyer, but it seems to me that having your record expunged applies to court records and not to some blog that notes you've been arrested in the past. For instance, I don't believe a police background check will uncover the rumor and hearsay of a blog.

I posted to this thread as slandered. I wish now I had chosen a better name. I never wrote that I had been slandered. However, "you" may have drawn that conclusion from my poor name.

I never intended for a war. All I wanted was my name to be removed from public display for something that legally never occurred and was expunged. Perhaps I received bad legal advice. Perhaps I misunderstood what I was told.

In any advent, I don't think I or any other person that may be in a similar situation as me deserves the hostility shown here. Perhaps I am naive. "You" probably will respond that I am stupid.
