Unlawful Arrest for Drunk in Public in Hotel

New Year's Eve was staying in a hotel in Fairfax County. Was asleep in my room after coming back from the sports bar where we had rung in the New Year, was awakened by a fire alarm going off in the hotel. Stepped out in the hall to check out and a police officer walked up and said I was under arrest for drunk in public. Was only in the hall for 5 seconds and officer had not even been in my presence long enough to observe me or my behavior and just automatically upon seeing me said I was under arrest. Said I was in the wrong place at the wrong time and if someone else had walked out of the room instead they would have been arrested. So are we supposed to stay in our hotel rooms when a fire alarm is going off.... No I don't think so, the hotel instructions are to evacuate to the nearest exit. After arrests made of multiple people for same thing....officers entered hotel rooms illegally and also were speaking unlawfully to guests who inquired about what was going on. Others were told to go back to their rooms and when they did they were arrested as they got off elevator. Someone please tell me how this was lawful or necessary. Fairfax County police should have been on the roads getting the drunk drivers on New Years rather than arresting people who were being smart and safe in a hotel room. Do we call this a little setup and entrapment. Let's see.... maybe the hotel was involved too...

even if the above story was true...it is not illegal for police to enter hotel rooms just as it is not illegal for them to enter a house that you are renting, if the land lord shows up and gives them the key to the front door to enter...there is a clause in rental agreements the allows for land lords to enter among other things if he has suspicions that there could potentially be a danger to his property or somebody on his property. just the same, hotels have similar stipulations in place...most hotels don't require you to sign anymore like a few years ago although you can still ask them for it...so yea if the police get the hotel room key from the front desk then the can lawfully enter without a search warrant.

we had a guy that worked for us(gov) that we thought was going to kill himself while holed up in his house...so we called and had the state police show up..at the same time we were on the phone with the district attorney trying to get a search warrant so that the police could enter. eventually the land lord shows up with the key and we ask if the police can go in. he gives permission, we tell the d.a. nevermind and the cops go in and take him into custody to get help.

Remember a few years back when the FCPD were arresting people inside bars and restaurants for drunk in public?

true story for sure it was Fairfax County and the Spring Hill Suites by Marriott across from Prime Time. People who were drinking at Prime Time celebrating New Year's got hotel rooms across the street to stay off the roads and be safe and some very law abiding good citizens and people who have never been in trouble were arrested when they stepped out of their rooms because of the fire alarm going off.
