can I join the Marines or Army with a felony arrest

i was enlisted nov. 2010 and adminstratively discharged dec. 2010, i was discharged for fraudulent enlistment RE-3. I had been arrested in Florida in 2001 for possesion of cocaine. I want to re-enlist and serve my country proudly but a National Guard recruiter said its not possible unless I get the arrest removed from the FBI database......will the Active Duty Army or Marines take me.......

no i was not convicted but i stil did pre-trial program.........I have even obtained a letter from my congressman recommending my re-enlistment.......

Yes I would, I would be a great benefit to the freedom of Americans.......It has been 10 years since I own a buisness with my fiance, I have a young son, and some college credits to show my contribution to being a law abiding citizen...

People make mistakes in life. I'm a firm believer in giving a man a second chance. However, most jobs in the various service branches require a Security Clearence. They can range from Confidential to TS and even require special acess at the TS level, like
TS, Special Background Investigation. That offence might or rather will hurt your chances.

thats what i was afraid of i was told that if i could get the FBI to remove it from there database i would be okay to re-enlist so that is my next step, I wont give up til all my options are extinguished and i appreciate ur feedback i wish there were more understanding people in the military like you

I know theyve cracked down on drugs, but my guess is the Marines no the Army maybe. Youll definitely have to talk to a recruiter and I am going to assume being an officer is out of the question but enlisting might be an option. You can try and get it removed from your record, but your biggest issue will probably be the fraudulent enlistment. Everyone makes mistakes but trying to hide it like that just made it harder. Go talk to a recruiter it cant hurt.

when i contacted my congressman he told me that he contacted the national guard and they said if i wait six months with my discharge being anRE-3 I could re-enlist. so i got a letter of recommendation from the congressman, im currently getting the arrest expunged from the state and the FBI database...that was the problem none of my criminal records reflect the arrest but after I was enlisted the Guard did my FBI security clearence it showed up...therefore I was discharged, and my lawyer told me that it would not be on my record, now i know otherwise so after all thats done I am hoping for a positive outcome....thanxs for your feedback appreciate it!!!!!

Well this could ban you from MEPS for awhile, if not indefinitely. You're lucky you just got an RE-3 and they didn't fine your ass or throw you in prison! Also if the National Guard recruiter told you that you couldn't enlist what makes you think you could enlist in the Army?! NG and the Army are under the same department which is the Department of the Army! As for the Marines, don't know but I am sure they wouldn't take you either. It's hard to enlist these days, all branches are screening their recruits vigorously. Too many recruits and not enough careers. Anyways instead of asking here try talking with a recruiter for the Marines! This applies to everyone asking the same "can I enlist _______?" Questions, WE'RE NOT FUCKING RECRUITERS! If you are interested in the Army I would suggest talking with a recruiter or going to goarmy.com and asking on their message boards and not FFXU!

I only asked the questions here to see feedback, maybe from soliders who are enlisted and know a fellow solider whom joined with similar circumstances.I was told to ask an Active duty recruiter for the Army by my Guard recruiter cause he says it maybe different with Active duty..........Ive done some research on felony waivers, they are availble, but i have taken it upon myself to even contact the FBI to get it removed from there database, I know some soliders dont wanna think a kid who was once in trouble deserves a chance, but im a positive person with a positve outlook, so I keep my head up and push forword..........thanxs anyway for the feedback

While i don't doubt your veracity, you have to understand that during tough economic times people flock to the military for its stability. Right now we in the Army we are looking for any excuse to kick people out, PT failures, height weight, failure to advance in rank. Getting that charge expunged from your record is going to be your best bet. Oh and the Marines are more anal about who they let into their club, if that drug charge is remotely findable don't waster your time trying to get into the Marines.

Or pretty much the same with any branch of the military! And no Army doesn't just let anyone in, they are really strict these days. Pretty much the only branch with jobs in every MOS available right now

FBI will never delete a record of an offense, they're funny like that. Years ago if you were a troubled kid the judge would offer you a choice (sometimes) if he saw potential to either enlist or jail, those days are over. You can try but you'd most likely would need the assistance of a lawyer, I don't think you have much of a chance on your own. But then again who knows. Bill Gates was a college droupout, sometime shit happens.

RE 3 is a reenlistment code meaning you can rejoin, but have to get a waiver; and you can be sure if the National Guard rejects you, the active component and Marines will reject you.


You shouldn't have denied the arrest in the first place, you know how easy it is to check these things?

Sure cooks and plumbers. But most jobs require the "ability" to get a clearance if the time demands> I know radio/antenna guys who never had a clearance who were sent to Secret instillations and the "need" for clearance presented itself. What does this kid want to qualify for is the question.

Then you would know the vast majority of combat arms, quartermaster, and transportation fields do not require a clearance.


You mentioned radio/antenna guys that might need a clearance; you would also know that the majority of people in the signal corps already have a clearance.

just depends on what your MOS is and what you really want out of the military. I know for the Army they are requiring more secret clearances which are actually fairly easy to get if you have an offense or history of alcohol abuse, it's the TS that's a pain in the ass. However, OPM who is a contractor for many of the clearances issued to the military (DoD no longer issues them) is pretty backed up at the moment so either you get your clearance because your MOS is in demand or you don't get cleared well into AIT. However, the point being with this guy is that he fraudulently enlisted instead of being up front when he completed his SF86. Which I am surprised they just issued an RE-3 and didn't lock his ass up because if he went through MEPS in Baltimore they don't fuck around so to say.

I contacted the FBI and they said if i get the arrest expunged, I need to follow up with the prosecuter of my case and make sure a copy was sent to the FBI then they said if my possesion was a minor possesion they will remove it from there database which i was arrested with.25gms which street value of $20, so the FBI is wrong by telling me that it can be removed from their database.......also i did not mention it cause my lawyer said it was all thrown out, but my lawyer wasnt thinking long term effects he just wanted the case dropped and that is my fault...I told my recruiter everything but that and when i was questioned about it i did not lie......ultimately a captain had the option to give me the waiver or discharge me and he discharged me cause I forgot to take out my earrings, I know it was dumb of me.

11 Xray, you don't become Bravo until go through BCT usually at Ft. Benning. I'm not trying to be a dick but I am not going to beat around the bush what you did was incredibly stupid! You should have told your recruiter about your charge and I stress this the captain at MEPS did you a favor by RE 3ing you. I wish you luck in trying to re-enlist but it sounds like you still have some growing up to do.

I appreciate the feedback and it was very stupid I shouldnt have listened to my lawyer......and the captain who discharged me was from my unit, not at MEPS......they let me even go to my first RSP Drill before I was discharged......once again it was stupid not to mention it.....either way they didnt give me a RE-3 discharge,thats what it was, administative discharge.......for fraudulent enlistment ,which i did not do intentionally, by any means if i knew it would have affected my military career i would have brought it to the recruiters attention from the jump and ive heard if we get a republican in office i will ahve a better chance due to the fact that republicans love war.......just what ive heard........I have no idea really......but to say i should grow up, this felony arrest was 10 years ago.I now own my own buisness, i have an associates degree in agricultural management, two career diplomas for Small engine repair, I own my house and i have a young very intelligent son who is awesome........Ive done my growing up im tryn to erase my past and move on in the future......and one guy said i should be in jail for the discharge, my lawyer should for screwin my future up...

It's obvious you have grown up some and learned a bit from this experience. I get the feeling your sincere in what your trying to accomplish. Just keep plugging, I know that sounds trite and weak , but what else can you do?

If you own your own business and house why are you trying to enlist?

And you said its been 10 years since your arrest, I'm guessing you were not a minor when you were arrested. So that'd make you at least 28, isn't that pretty close to the cut off age for enlistment?

Yes ur right i am 28 and the cutoff is 35-40 this is what my recruiter told me......I own a buisness with my fiance who would run it til i at least got out of BTC and AIT at Benning my doctor told me when i got a physical last year im as healthy as a 20 year old if you knew me personally you would say i look 23-24 some say i look even younger!!!!!

WASHINGTON - More recruits with criminal records, including felony convictions, are being allowed to join the U.S. Army and Marine Corps, as the armed services cope with a dwindling pool of volunteers during wartime.

The military routinely grants waivers to take in recruits who have criminal records, medical problems or low aptitude scores that would otherwise disqualify them from service. Most are moral waivers, which include some felonies, misdemeanors, and traffic and drug offenses.

Defense Department statistics show that the number of Army and Marine recruits needing waivers for felonies and serious misdemeanors, including minor drug offenses, has grown since 2003. Some recruits may get more than one waiver.

The Army granted more than double the number of waivers for felonies and misdemeanors in 2006 than in 2003.

The number of felony waivers granted by the Army grew from 411 in 2003 to 901 in 2006, according to the Pentagon, or about one in 10 of the moral waivers approved that year. Other misdemeanors - from petty theft or writing a bad check to some assaults - jumped from about 2,700 to more than 6,000 in 2006, representing more than three-quarters of moral waivers granted by the Army.

Army and Defense Department officials defended the waiver program as a way to admit young people who had made a mistake but overcome past behavior.

Lawmakers and other observers said they were concerned that the struggle to fill military ranks in this time of war had caused standards to fall.

"Our armed forces are under incredible strain, and the only way that they can fill their recruiting quotas is by lowering their standards," said Rep. Marty Meehan, a Massachusetts Democrat who has been working to get additional data from the Pentagon. "By lowering standards, we are endangering the rest of our armed forces and sending the wrong message to potential recruits across the country."

Army spokesman Paul Boyce said Tuesday he was concerned that the Pentagon data differed from Army numbers, but said that "anything that is considered a risk or a serious infraction of the law is given the highest level of review."

"Our goal is to make certain that we recruit quality young men and women who can keep America defended against its enemies," Boyce said.

The data was obtained through a federal information request and released by the California-based Michael D. Palm Center, a think tank that studies military issues.

"The fact that the military has allowed more than 100,000 people with such troubled pasts to join its ranks over the past three years illustrates the problem we're having meeting our military needs in this time of war," said Aaron Belkin, director of the center.

The military also does not have programs that help convicted felons adjust to military life, according to a new study commissioned by the center, Belkin said.

As the Iraq and Afghanistan wars have dragged on, the military also has relaxed some standards in order to meet recruitment demands. The Army, for example, increased its age limit for recruits from 35 to 42, and is accepting more people with lower scores on a standardized aptitude test.

The Pentagon said in its report that "the waiver process recognizes that some young people have made mistakes, have overcome their past behavior, and have clearly demonstrated the potential for being productive, law-abiding citizens and members of the military."

The military in its report divides moral waivers into six categories: felonies, serious and minor non-traffic offenses, serious and minor traffic offenses and drug offenses.

According to the Pentagon, nearly a quarter of military recruits in 2006 needed some type of waiver, up from 20 percent in 2003. Roughly 30,000 moral waivers were approved each year between 2003 and 2006.

About one in five Army recruits needed a waiver in 2006, up from 12.7 percent in 2003.

More than half of the Marine recruits needed a waiver in 2006, a bit higher than in 2003, and largely due to their more strict drug requirements.

About 18 percent of Navy recruits required a waiver, up slightly from 2003.

Just 8 percent of Air Force recruits had waivers, down a bit from 2003.

Actually no. Its close if he were to be going to OCS but to enlist for the Army you can be 35 and even up to 40 now if you can meet the physical requirements and get a waiver

Also Dustin look at the date of the article. That was at the height of the fighting and before the economy hit the shitter. As mentioned by someone else before, as the economy gets worse more people try and join as a career path making them more selective and they were right about that. Same thing goes with law enforcement and Im sure ems as well.

Dustin, look at the date of that article. Now look at this article which was written by the same newspaper but more recently. http://www.washingtonpost.com/wp-dyn/content/article/2009/04/18/AR2009041801992.html. It clearly states that as of 2009 they are not accepting felons or even prior juvenile offenders. Dustin, the military is extremely overloaded now. If this were 5 years ago you would leave for bct tomorrow. Now if you get accepted you are looking at 6 months DEP until you leave for basic. That's a long time but consider that the air force isn't shipping out their recruits well into 2013 and the marines at the end of 2012 if you are lucky. Also with all of the stories surfacing about troops committing heinous acts against civilians and the rising number of PTSD cases due to preexisting psychological conditions for which waivers were granted, they are being extremely selective. Also I know you wouldn't do any of those things or, hopefully, commit any crimes against your fellow soldiers but you have to realize what if your fellow soldier stole from or assaulted you who received a waiver for prior criminal convictions? You would probably be pissed off that they let someone like that into the Army. The last thing the Army or the military in general would like to be known for is a last resort or career option. They are looking for fresh recruits who consider their career path in the military as a career. With the rising number of college graduates enlisting (OCS as a civilian is clogged) wouldn't you be more selective knowing that a college graduate with the rank of specialist could fulfill the same MOS as an E1 or E2 coming in with prior convictions or conditions? And probably be more knowledgeable about the MOS they are pursuing? So you have to look at it like that. It's not because they hate you or want to ruin your life, honestly it sounds like you have a great thing going for you. You said you have a business, a wife, kids, and an associates degree. Really think about what you would be sacrificing, military life with a family can be stressful and more difficult. Think about the fact that they won't be there with you for BCT and AIT and if you get deployed you will be gone for a year. Lastly, in the Army you move around where ever you are needed so one minute you could be at Ft. Carson where your kids are in school and you're wife is working and then your unit could be reassigned to Schweinfurt, Germany! I admire you're ambition and desire to serve our country, however in my opinion I think you should stay with your profession. Choosing a combative MOS can be dangerous as the name implies, just today 5 troops and 11 civilians were killed in a suicide attack in Kabul Afghanistan. Think about how devastating that would be not only for your loss but for your wife and kids!

thanks for you input sounds like your pretty educated about this and i wanted to join when my son was born but didnt want to miss all the cool things kids learn frombirth to first day of school......i also chose the infantry i could had a mechanic slot but chose infantry......i understand what ur sayn about family but mine has agreed and want nothing else but for me to achieve my goal as a solider...........ur also right i would be mad if a solider stole from me and had a conviction for stealing but i was screwed with my arrest someone stashed so coke in my laundry when the cops came to my house on a fake 911 call and because it was in my house and nobody would claim it i got stuck with it, i have learned to surround myself with positive people and not people into "bad" shit........I know where overcrowded but until my discharge i was told what a great benefit i would be to my unit and my fellow soliders.....its just depressing cause im not doing it for economic stability I have that Im doin for the cause thats why i chose infantry not alot of infantry men can find jobs outside the military cause its not a civilian skill to kill so i feel like ive been robbed of my career in the military cause i havea career outside the military but its somethin i want

i have been told that if the draft was reinstated i would be re-enlisted cause ive been through MEPS and cleared for duty, what the chance of this happening and was i false informed!!

Sorry, you just sound stupid. For wanting to go in the army. You've got a wife and kid,and a source of income. If there comes a time when they need to do something that's going to get a guy killed you are the guy they will choose. The fact that you got arrested for a quarter gram of coke is another piece of evidence. I can accept that you had a bad lawyer, been there. Stay the fuck out of the military. If you were not married you could join the Foreign Legion, there was a program on the Military channel, a documentary, and it showed a couple of guys who were booted out of the US Military, that joined the Legion. What a story that would be for your grandkids. And they are one tough fighting unit, imagine having that on your resume. You'd have no problem hooking up with a military contractor like the old "Blackwater" for big bucks.

Wow, that was real nice so i miss typed soldier..........a couple of times.I dont think that determines my validity to serve my country......i saw guys who had ASVAB scores below 30 and stil enlisted...those are the people youd prefer to defend our country, your fuckin stupid...a 30 means you have barely any common since not the guy id want on the frontline to have my back.......and its soldiers like you that just sound dumb.........every man or women physically capable should be givin the right to serve their country..on top of all that 70% of soldiers deployed right now are on some kind of drug so what makes them any better cause they waited til they enlisted to become addicts....dont think so.next time get educated before you talk shit about my intentions......

Dustin, I think you need to make other plans. First you have what the Army refers to as "other adverse disposition (OAD)" for a felony. It's not a conviction, not an acquittal, but it would require a felony waiver. It happened and nothing you do now will change that. Next you have a fraudulent enlistment discharge that also requires a waiver. The military is again downsizing and a lot of good soldiers in over strength MOSs are being forced out through retention control points. And if they are forcing good troops out, you should know dual waivers like the ones you need are not being considered.

Regarding your comment about Republicans liking war, and your chances for enlistment after the next election; most of the major modern wars that we have been involved with this century began under Democratic leadership (until the GWOT). Refer to Vietnam (kennedy/LBJ), Korea (Truman) and WWII (FDR).

I appreciate your sincerity and desire to serve, but I don't think you'll be able to get into any branch of the military.

I believe everyone deserves a second chance, but it seems like maybe you should cut your losses and try to do something else with your life. Odds aren't looking good for the military at this point. Don't worry about it, there's other stuff out there Dustin.

BTW, If you've never done coke why did you have 0.25 grams with you when you were arrested?

An aquintance of mine hid the coke in my laundry basket when the cops came for a false 911 call about a stabbing they went into my house and found a film bottle with the coke and when they asked the people at my house if it was theres they all said no, and cause it was my house I was arrested for it, since i have learned a life lesson on how to pick better people to surround myself...all i hangout with now are soldiers form the unit i was in...I am a tattoo artist and i tat alot of soldiers from my unit!!!

I am 20 and a convicted felon, my charge was aggravated assault with intent to commit a felony. I was in the delayed entry program for the Marines when I was a senior in high school and discharged because I wanted to go to college first. More than anything I want to be in the military and always have. Is there any chance, with my conviction, that I could still re-enlist?
