In New York at McDonalds. Black women jump black cashier. No racial here, just two bitches getting what they deserved. The cashier is being charged with felony assault but I think he should be given a medal and a guest spot on Jersey Shore.

From what I read before, the women are being charged with two things each..don't remember what they are. The guy should be charged for sure, just not with felony assault. Sure, he used an object to strike them and sure he hit one of them in the head when she tried to get up (+1) but it isn't like he used a giant lead pipe. He used a very thin rod. Spare the rod, spoil the customer..

Somewhere I read that the two women tried to pay for their food with a fifty dollar bill and the fast-food guy questioned something about it (HOW he questioned it wasn't said). The two women then went after the guy who, not surprisingly, defended himself. His problem is he didn't know when to stop and stepped across that ambiguous line from defense to offense.

Exactly, That guy was just doing his job and they accosted him. He did not have time to think before he acted, decisions made in real time are rarely perfect. He was not a LEO who is trained to think on their feet. Who is to know if they may have pulled a gun while on the ground, I would not have taken the chance. I woulda whopped that bitch till she was unconscious.

Of course I have a fantastic attorney and would not be too concerned with a guilty verdict.

My belief - if you do shoot someone in your own home that breaks in, make sure they are dead. Unreal that they could then come back and hit you with a civil law suit for "hurting" them.

No, cause only seconds after the video ends, that dude is back there, working the fryer, working his ass off just to make, what, $6.50 an hour? Most McDonald's employees have pent-up anger issues. Yeah, but at least then it is not first hand testimony from some jackass in a body cast or with a a neck brace or something. All the family can do is hope they get a jury that takes a dislike to the homeowner. And then I would counter sue them if they wanted to take it that far - only seems right if they are going to drag your ass into court they get to pay for the privilege.

Yeah, I have to agree that based on the video it was a case where it would have been better to just get out of their way (the women who jumped the counter). They would have been arrested and the guy would have just been doing his job. Their was definitely a lot of "you want some of this!" BS going with that guy, and then he obviously began using the club well beyond any intent of just keeping them away from him. If he had just threatened to hit them, or held them off with it he would have been fine - but the obvious malicious intent of his follow up is going to be very bad for him.

How is it hard to explain being caught-up in the moment? They were in the process of assaulting him out of the blue. It was his quick thinking that kept him out of the hospital, its not like he took their unconscious bodies and dumped their heads in the deep fryer. He didnt change weapons nor position them "curb stomp" style ala American History X. They came over a counter that by its very nature is intended to keep separation between employees and customers. He didnt come around the counter at them, they came across at him, with hostility.

If you think this guy deserves to be prosecuted, you are an anti-liberty boot-licker.

Unless that bitch put her hands behind her head and assumed an arrest position, he is well within his right to protect his life and liberty. If she was conscious on the floor the cashier did the righteous thing by protecting himself, fellow coworkers and customers.

You must look at this in a worst case light. What if she pulled out a concealed handgun and started shooting the place up, some poor kid takes a stray round to the dome and dies, I bet you would be accosting the cashier for not doing everything he could to protect her. Once you choose to take the role of aggressor in a public place, you deserve to be totally incapacitated until all facts can be ascertained.

Yes, you can (and they do) legislate how far is too far. Given, there is a grey area, but if you are being attacked and you get the upper hand, there is a point where it transitions from defending yourself to becoming the aggressor.

He would not have been justified to grab a knife and stab them to death. Likewise, if someone is on the ground and they are not posing a threat to you, you can't just tee off on their head with a metal rod.

And whether you think it's right or wrong, that's what the law says.

Thats what the law says? What law? This is a political prosecution, they had to come up with a charge and try to make it fit. There is no law on the book that stipulates how far you can take protection. It is all a grey area. I guarantee that if this had happened here in the Commonwealth, there wouldnt be a DA in the state that would dry to make a case out of it. And exactly how do you know the girl posed no threat while on the ground? Also, If he had been holding a knife when she came across the counter, he damn well would have been within his rights to stab her.

Here's the thing. The law doesn't care about his motivations beyond stopping whatever it was they were doing to protect himself. Once he stepped up and went for the overhead downswings he was fucked. You play that back in court and no amount of "caught up in the moment" is going to save his sorry ass. I don't deny he was within his right to try and defend himself, but - he went a few swings too far. If he had killed one of them he would for sure be convicted of manslaughter.

I feel bad for this guy. Look at the video, the guy was attacked. Was his response over the top? 2 people came into Mcdonalds, the cashier questioned the bill. The 2 people become irate spit on the cashier, jump the counter and strike the cashier. The Cashier retreats, the two customers pursue the cashier. He grabs what he can find and comes out swinging. I don’t know if you’ve ever been in a street fight or not, but if you are facing multiple odds, you take your attackers out ASAP, and you make sure they don’t get up. Simple rules of the street. I shouldn’t have to explain why to you. All I can say, is put me on that jury, that boy will walk

The guy was actually working a skid job trying to make something honest of himself, instead of slinging crack on the street corner, or resorting to a life of crime, which would have been very typical after 10 years in prison. Hopefully, he’ll have a jury made of people who see it the way I do–he was defending himself with what he learned was justifiable force. This guy doesn’t deserve to have his life ruined over this. Good luck, to him. His so called “victims” deserve to be thrown in prison.
