A Las Vegas police officer under investigation for the videotaped beating of a man in March violated several Metropolitan Police Department policies, an internal investigation found.

Mitchell Crooks' complaint about officer Derek Colling's excessive force was sustained, Deputy Chief Gary Schofield said Friday.

The specific policy violations will not be released until the case is finalized.

Crooks, 36, received a letter from the Internal Affairs Bureau notifying him of the findings earlier this week.

He said he was pleasantly surprised.

"It seems like they're saying he was guilty, which is what I've been saying," Crooks said. "I really hope he gets fired."

Colling has been on paid suspension since April 1.

Multiple supervisors in Colling's chain of command will review the internal affairs report and decide his punishment, if any, Schofield said.

That review could take several weeks.

If Colling's supervisors recommend his firing, he will go before a pre-termination board for a final appeal. The harshest punishment short of firing is a 40-hour unpaid suspension.

Crooks' lawyer, David Otto, intends to sue Colling and the Police Department.

Otto wrote a letter in April to Sheriff Douglas Gillespie demanding $500,000 to cover Crooks' medical care, pain and suffering. The Police Department has not paid anything, he said.

He intends to send another letter to Gillespie.

"Mr. Sheriff, show us the difference between what the officers did to Mitchell Crooks that night and kidnapping, beating and robbery," Otto said.

On the night of March 20, Crooks, 36, was in his driveway, near East Desert Inn Road and South Maryland Parkway, videotaping police as they investigated a burglary report across the street. Crooks said that when he refused to stop filming, Colling arrested and beat him, with much of the altercation recorded by the camera.

The video went viral on the Internet, and local activists and national "cop watch" blogs scrutiznized Colling's actions.

Local American Civil Liberties Union lawyer Allen Lichtenstein reviewed the video and found clear policy violations.

"It raises serious questions about whether the officer used good judgment and whether he was properly trained," Lichtenstein said. "Those questions require answers."

Rank-and-file officers who spoke to the Review-Journal after the incident were as demoralized as the public was incensed.

"The majority of us think Colling made a mistake," one patrol officer said. "All the officers I talked to understand that citizens will see this video, and yeah, we know it looks bad."

Neither Crooks nor Colling was a stranger to controversy.

Colling has been involved in two fatal shootings in his 5½ years as a Las Vegas police officer.

In 2006, he and four other officers shot Shawn Jacob Collins after the 43-year-old man pulled a gun at an east valley gas station.

In 2009, Colling shot and killed Tanner Chamberlain, a mentally ill 15-year-old who was holding a knife at his mother's neck and waving it at officers.

Both shootings were ruled justified by Clark County coroner's juries.

Chamberlain's mother, Evie Oquendo, sued Colling and the Police Department in May.

When the lawsuit was filed, Oquendo's lawyer asked why Colling was still working as an officer.

"He's killed two people in 5½ years and beaten one guy up that we know of," Brent Bryson said.

Crooks made headlines in 2002 when he videotaped two Inglewood, Calif., police officers beating a 16-year-old boy.

Crooks first tried to sell that tape and refused to give it to prosecutors. He then was jailed on old warrants from drunken driving and petty theft charges. Civil rights advocates decried the jailing as retribution.

He has lived in Las Vegas since 2003 and worked as a freelance videographer.

Crooks, who still carries his camera, said he was stopped last month by a Las Vegas officer who recognized him .

He was issued a ticket for no proof of insurance that was later dismissed, Crooks said.

Screaming like a bitch is not against the law.

Being a videographer is not against the law.

Videotaping cops is not a against the law, especially from your own driveway.

Beating and arresting people because you're angry is against the law. Harassing people you don't like is against the law.

I really do take exception to officers behaving like this. First and foremost, yes, the videographer did make a mistake of initially saying he didn't live there, but all the officer had to do was request some ID, and the problem would've been solved. Second, this was all done out of embarrassment, ignorance, and so forth, and it had NOTHING to do with the law which the officer recited. The officer was embarrassed that he approached the homeowner under the false presumption that he was an intruder, and so he took the anger from that and unleashed it on him. He ignored basic procedure in asking for an ID when in doubt, and then on top of that he actually proceeded to assault someone on their own private property without any justification at all. Say what you want about the videographer's past history, but the cops were wrong on this one.

I think the cop was justified. The suspect at the time clearly said that he did not live there and was, what appeared to be at the time, casing the joint. The suspect then changed his story and said that he lived there. I'd be suspicious right there, I mean which is it? Why change your story? Then he starts to go into hysterics like some "nut on goofballs" or under the influence of something there. too bad they saw otherwise, the kid maybe had a wealthy daddy, who knows.

That's true, but civil disobedience is when you break a law to make a point, like protesting without a permit, etc.

Videotaping cops is not civil disobedience. It's just another legal activity, like walking down the street.

If I stood across the street, not on your property, and video-taped your house. I'll bet you it would piss you off and you'd react. And you'd be out of line, you own the property, but not the image of the property. That's what the cop did, in certain ways.

What does it matter if he does or does not live on the property? My guests would be completely within their rights to film on my property with my permission, regardless of ownership of the property.

The cameraman was clearly confused and thought the cop was asking if he lived across the street, where the initial incident was taking place. This is just another prime example of the police overstepping boundaries and intentionally asking ambiguous questions in a strong-armed attempt to keep any situation on their side.

It is disgusting. Police can tell you to leave the scene of an incident and you must comply. They say it is for officer safety, in reality, it is an unlawful effort to remove lawful bystanders from observing public officials while performing their duties. That cop should be stripped of his badge on the spot.

My point regarding civil disobedience was the act of "disobeying a police officer". A lot of folks will blame the citizen and declare them a "dumbass" and they deserved a beat down for not doing what the cop told them to do. Obviously sometimes they do. But often they do not.

No, because a camera can't stop you from getting beaten or arrested. But video of a cop breaking the law can help clear your name later when the cop falsely charges you with a bunch of stuff to try and show you who's boss.

And public scrutiny is really the only thing that keeps police from acting the way they do in some countries, where cops can murder you in public and get away with it.

Exactly. The fact of the matter was no MATTER what the guy said, even if he explained his own viewpoint, the cop STILL would've asked him to stop filming. Perhaps, you could argue that, case in point, that it was none of the guy's business and it whoever the fuck knows could've been interfering with an investigation or something like a murderer was on the loose or something OTHER than the fact that the cop just didn't want the guy standing there filming and all he said is that you don't live there dude. Does it really matter ? of course I think not, he could've been standing in the patio or something a hundred yards away and this still would've happened because it's just a matter where you draw the line ..really it's just what you're prepared to sacrifice for others to feel better.

There's a reason for the LA riots. There's a reason behind the serious mistrust issues between the public and california. I'm not a story teller, so just do your research and noting good will you find ,but it isn't my job to belittle you so you can learn how to take care of yourself.

You have a right to have a camera and defiant attitude, and you even have a right to lie to them. None of that warrants what that cop did, he just did it because he was pissed, wanted to have his way, and thought he could get away with it because of his uniform and position in society.

Tomahawk strikes me as the type of guy who is bitter. The type we refer to as a "jockstrap cop", he must of had wanted to be a Police Officer once in the worst way and ended up flunking the physical or mental aptitude exam. Those are the breaks, it does not mean your a bad person, only that your lacking. If I ever saw you filming me in that situation and you then lied as to you purpose there, I would not beat on you, lessen you beat on me first, but you would need to answer some questions. That's called "doing the job".

I have no idea how you went off in this direction.

That said.........here's where evidently you and I differ. You fear the police. I do not. I don't because I don't put myself in a position to be on their bad side. I have no idea why you fear them, only you know the answer to that. I hope it doesn't come from headlines.

Now don't get me wrong. I have no love of the Fairfax County Police Department. Several times in the last 10 or so years I've needed them to just do their jobs......and they've failed me. Miserably. As recently as last Friday to be exact.

I'm no saint and I'm far from subservient but I simply do not put myself in a position to give any cop a reason to behave the way the one in the video did.

Are there people with badges that shouldn't have them? Fuck yeah. But I still contend that had that dude done what he was told to do...hell, he could have stopped taping and simply walked to his front doorway and started taping again..he wouldn't have gotten his ass kicked even by a psycho cop.

That clown was expecting the police to take care of him.......I don't put that much faith in any cop..even the good ones. But I don't push their buttons either.

I doubt seriously that that particular cop rides around looking for people with cameras so they can kick the cameraman's ass.

If there wasn't so policy within his department in place about "removing citizens with cameras to a safe place" (or some such bullshit to keep the cameras out of their faces) I find it hard to believe that the guy wasn't fired immediately.

You are right...........none of what the camera clown did warranted the outcome, but what could possibly be so important and demanded his filming it that he'd disobey even a bad directive from a police officer?

Forget what you see on the video for a minute. Suppose the other police in begining of the video were about to drag some slob out of his house. Say that slob killed some babies after raping them and eating half their dead bodies.

And say that this clown puts his face on youtube, the killer's lawyer uses that as a technicality to get his client off and the guy walks.

Who's side would you be on then? Nothing is ever as simple as it seems.

Nothing is black and white. You're right, the police could have been up against a million different situations that you would think dictates acting in this manner, but I doubt it was.

That's what he implied in the above. I can support that also, it is like Tomahawk said I have the right to. Or is it just a one way street, cops can't have a unique opinion. You ultimately have to do what the law commands, but you are still entitled to a contrary opinion. I don't believe in Homosexuality, but I have no qualms about them serving as cops.
