An Oklahoma pharmacist has been sentenced to life in prison with the possibility of parole for first-degree murder in the shooting death of a teenager who tried to rob the south Oklahoma City pharmacy where he worked.

Fifty-nine-year-old Jerome Ersland was sentenced Monday after Oklahoma County District Judge Ray Elliott rejected a defense motion to suspend the sentence.

Ersland had no reaction and said nothing as the sentence was handed down. As he left the courtroom, he responded to a reporter's shouted question by calling the sentence "an injustice of a monumental proportion."

A jury convicted Ersland and recommended the life with the possibility of parole sentence for the May 2009 shooting of 16-year-old Antwun Parker. Defense attorney Irven Box said the conviction and sentence will be appealed.

Confronted by two holdup men, Ersland pulled a gun, shot one of them in the head and chased the other away. Then, in a scene recorded by the drugstore's security camera, he went behind the counter, got another gun, and pumped five more bullets into Parker as he lay on the floor unconscious.

At the trial, prosecutors argued that Ersland crossed into the wrong when he shot the unarmed and unconscious Parker five more times.

Ersland contended that he was defending himself and two co-workers from a robber who still posed a threat.

First degree murder sounds a little harsh for killing a man as a reaction to a robbery the dead man instigated. Seems like an aggravated or willfull manslaughter would be appropriate as it is hard to justify shooting an unconscious man. even in the heat of defending against a robbery.

Maybe the tape shows the geezer shooting the perp in what appears a callous or premeditated way. If it's a quick series of five shots, thats one thing, but if the pharmacist was talking shit and took time between the caps he blasted, I could see a jury being a little less agreeable.

Shooting an armed robber to protect yourself is self-defense. Unloading your entire clip into an unconscious person is psychotic.

I'm sure the murder one charge came from the five extra shots. But considering the first shot was to the head, wouldn't abuse of a corpse have been a more appropriate charge?

The defense attorney sucked dog if he didn't try to sell the jurors on the passion, excitement and general insanity that comes when someones life is threatened or if they are the victim of a serious crime as such.

What could appear mailicious and cruel to some may have seemed perfectly appropriate to someone else. The defense should have addressed the panic and possible diminshed capacity that came witht he extra shots.

But maybe the tape shows several minutes between the shots or some kind of calm, controlled and deliberate manner. Until we see the tape or hear it described, we don't know.

OK here is a little persepctive on why the jury arrived at the conclusion they did. I feel the guy was pretty much justified and the punk got what he deserved, but there is just a little too much time between the fleeing the the other suspects and the extra five holes put into the unconscious robber. Looks like the shooter is not in any serious danger at that pint and is controlled, deliberate enough to find a second pistol and pop off the five that killed the perp.

The DA is still kind of a dickhead and really should have pushed for 2nd degree murder or voluntayr manslaughter. The pharmacist needs a little camp time for this but certainly not life.

So the guy who stabbed Sal Mineo to death in a robbery got 57 years and then got paroled in less than 20, and this guy gets LIFE?

Seems a bit extreme.

Part of gun ownership is knowing what you can and can't do. Once the immediate threat was done he needed to call the cops and be done with it. "Finishing off" the guy on the ground isn't something you can do and get away with in a store with video cameras when there is clearly a robbery happening and you aren't going to go to jail for life for ending the threat.

In your house... the wisdom of that is perhaps arguable.
