Hey wait... If I write down an anecdote from Burning Man, is that copyrighted, too? Logically, I think it is.

What a load of shit. This whole time I thought it was just the photographer that was getting all uptight about his pictures being used. Who would have thought the organizers of Burning Man itself are actively searching the internet for unauthorized photos of the festival. How corporate-like.

Both Cary and Burning Man use power to establish and control quasi-anarchic events so that the events do not transgress certain boundaries; and if those boundaries are transgressed, each party will use such power as they have to punish the transgression, with increasing force if the transgression is persisted in.

The main difference is that Burning Man's scope of power is greater than Cary's.

For example, Cary's ban hammer does not extend beyond the scope of this board; Burning Man's DMCA takedown hammer extends as far as the power of federal law extends.

Interesting... but don't you think Cary uses his power mainly for "the greater good"? Whereas Burning Man is using it just for profit..?

I think intention is important to consider...

You're thinking about trademarks, not copyrights. Please stop playing armchair lawyer.
