It stays in the database so when you do it again next time and don't get off on a technicality they can link your evidence again.

Like the technicality that you are actually NOT GUILTY. Sometimes the people who are arrested did not commit the acts they are charged with. In other cases the acts they committed were not crimes.

It depends. In Virginia, a defendant's DNA is automatically tossed (ie, Expunged) upon a final deposition of Not Guilty (Or Dismissal).
