Katie wasn't innocent at all. She was a cheater who cheated on Kristy with Mo, Erick and the boss of papa Johns. She lied and said Erick raped her and when Mo told Kristy what was going on had Mo arrested on multiple false charges that didn't stick. Cheating, i.e. dating other people, is not a crime. Posting Katie's nudes with malicious intent is a crime. Obstructing Justice by harassing witnesses is a crime, and the posting of witnesses' personal details and photos were also separate crimes.

Miz, liz, eesh, Lynn or TJ all would know about the witness intimidation. Monique Wells was a participant in the harassment and defamation of witnesses, although she had been in jail for a little over three months when William Moreno boasted about it. She certainly knew what she and William were doing to harass witnesses was illegal while they were doing it. She may not have realized that had Basl been smart enough to present the evidence to the court, he could potentially have walked free as a result of her actions.

The Morenos harassed and intimidated numerous witnesses, including TJ and Lynn Sadler. They followed Lynn out of the Fairfax courthouse building in July 2016 and posted her photo here. Then immediately following Basl's Fairfax General District Court horn beeping trial on August 25, 2016, the Morenos began a harassment and defamation campaign against witnesses who had been called to testify that day. There were literally hundreds of incessant, almost manic, defamatory posts and threads, including names, photographs and protected personal information of the witnesses. Then nearly as abruptly as it started, all the harassment essentially stopped when Monique went to jail on September 11.

Basl/eesh appealed his August General District Court verdict to Circuit Court and trial was set for January 11, 2017. Shortly before that trial on December 31, 2016 William Moreno signed in to his registered "voodooslut" username and made a boast that eesh had "zero witnesses" for his upcoming appeal. Indeed at the Circuit Court trial eesh had no witnesses and he was found guilty. For reasons unknown eesh did not follow through to the Virginia Court of Appeals.

Inexplicably, Basl/eesh and his attorney failed to recognize that Moreno had handed him grounds for appeal and possible acquittal on a silver platter. The boast was provably from Moreno, and the harassing posts from the District Court trial were still on the Fairfax Underground website, with many originating from Moreno's apartment in Fairfax City. Attempts to prevent witnesses from testifying are grounds for appeal. If Basl had requested an appeal, the Morenos would have been less sympathetic and the outcome possibly different, although no verdict is ever 100% certain. Nevertheless not only would Basl have had another shot at exoneration, but the Moreno could have been charged and very likely convicted of criminal offenses including § 18.2-460 Obstructing justice, § 18.2-186.4 Use of a person's identity with the intent to coerce, intimidate, or harass, and § 18.2-386.2 Unlawful dissemination or sale of images of another.

He got two minor misdemeanor convictions for beeping his car horn, which are still the only criminal convictions he has. They mean virtually nothing for anyone. Misdemeanors generally have low or no impact unless the crimes are of moral turpitude or violence, which these were not. He'd have to weigh the cost of the appeal vs. benefit of acquittal.

The Virginia Court of Appeals would not have increased the sentence imposed by a lower court. In Marano v. United States the court stated that "a defendant's right of appeal must be unfettered" and that defendant "should not have to fear even the possibility that his exercise of his right to appeal will result in the imposition of a direct penalty for so doing." Furthermore, following United States ex tel. Starner v. Russell, 378 F.2d 8o8 (3 d Cir. 1967); Shear v. Boles, 263 F. Supp. 855 (Va. 1967) "courts are reluctant to interfere with the trial judge's sentencing decision because they feel that he is in the best position to determine the appropriate sentence and that this evaluation should be honored."

Punishment must be proportionate to the crime. He beeped his car horn at the Morenos while leaving a deposition. Article I, Section 9 of the Constitution of Virginia, establishes the principle that “the punishment should not be disproportionate to the crime." Even if found guilty he would be allowed habias relief for any time he served prior to the trial.

Because the previous trial was tainted by actions of the Morenos to intimidate and harass witnesses, that would be on the table as evidence. Courts take a very dim view of such attempts to subvert the judicial process, and nearly always result in a verdict in favor of the party which was wronged by an obstruction of justice. While not a 100% guarantee, chances are very good that Basl would have been successful in the Virginia Court of Appeals.

Impossible to predict ahead of time time, but by the time the case would have been tried, Richard Moreno was dead.
