Finally something good happened we can all hang our hats on! Kind of breaks the monotony of these dog day afternoons.

I think if I remember right this guy was appointed by one of the Bushes.

SAN FRANCISCO – A federal judge overturned California's same-sex marriage ban Wednesday in a landmark case that could eventually land before the U.S. Supreme Court to decide if gays have a constitutional right to marry in America.
Chief U.S. District Judge Vaughn Walker made his ruling in a lawsuit filed by two gay couples who claimed the voter-approved ban violated their civil rights.

Biography

Walker was born in Watseka, Illinois, and graduated from the University of Michigan in 1966 and Stanford Law School in 1970. After serving as a law clerk for United States District Court for the Central District of California judge Robert J. Kelleher from 1971 to 1972, he practiced in San Francisco at Pillsbury, Madison & Sutro from 1972 until his September 7, 1989, nomination by President George H. W. Bush to the federal district court. Walker was confirmed by the U.S. Senate on November 21, 1989, on unanimous consent and received commission on November 27, 1989. Walker is one of two federal judges publicly known to be gay.[1]

Well if our courts don't want to stand behind the voters, there is a larger issue there to deal with, but if so, straight people will have to RE-WORD THEIR UNION UNDER THE EYES OF GOD. Queer unions are NOT the same as 'marraige' between a man and a woman who wish to procreate and the difference should NOT be CONFUSED.

I'm all for Queers making permanent recognisable unions, but CREATE your OWN FUCKING TERM THAT ACKNOWLEDGES AND DIFFERENTIATES THE 2.

The govt should get out of the marriage business, period. Allow any couple, gay or straight, to enter into a civil union. Then let churches decide who can and can't get married.

That gives gays equal rights, satisfies libertarians with a "small govt" solution, and gives churches the freedom to marry whoever they want.

I'm on the same page really. But If you were a married man, and took your vows with your wife seriously and saw a special interest group trying to cloud the historical and symbolic signifigance of your union, and merge the two as though they are one, you would care.

Also why should the government stop allowing legal RECOGNITION of marraige?

Call the gays shit a union, and give them both the same tax bennefits.

This is just like the Meepers solution except it eliminates the BULLSHIT.

I like this idea, as long as civil unions have the exact same rules and benefits of current day marriages.
If you want to follow the "rules of God", good for you, just do it in a church.

If you remember back when this vote took place, many of the voters were confused whether Prop 8 supported or condemned gay marriage and many people that actually opposed it, accidently voted for it. California is a very accepting place for people of all races, genders and lifestyles, so I found the results of the vote surprising until I heard about all the confusion. I just can't believe there are that many Mormons and other religious nutters to get Prop 8 passed in a place as liberal as CA.

A poll today in the Washington post shows that 80% are in favor of gay marriage.

When the ruling (and voting) majority gets to decide the minority's rights, they usually get it wrong. That's why we have a legal system in this country - to provide a safeguard against the minority's rights being trampled over.

Last night, flipping channels between Rachel Maddow and Sean Hannity; this ruling was a hot topic. Rachel interviewed legal correspondent from Slate magazine Dahlia Lithwick, and then David Boies and Ted Olson, the two lawyers who argued the case for the prop being unconstitutional. The same Ted Olson from the GWB White House; the same Ted Olson who argued in front of the Supreme Court to drop Miranda; the same Ted Olson who argued for Bush in Bush vs Gore. And while we are pointing out legal resumes, the same David Boies who argued for Gore in that Supreme Court case.

The “Conservative media,” by way of Hannity, countered with equal legal intellect, which made for great political and legal theatre. STOP! I am sorry, Hannity had on Sarah Palin to talk about this decision. You are not misreading this, Hannity had on Sarah Palin at the beginning of his program to provide insight and to educate the American public on prop 8 being ruled unconstitutional. I couldn’t make this crap up if I tried. There is no one on the face of this Earth, other than Sean Hannity it appears, that thinks Sarah Palin has the mental capacity to educate an provide intellect on this issue. Say what you will about Rachel, but she educated the public last night. At the same time, Hannity provided crap.

My concern has nothing to do with most of the issues raised thus far.

If the Gay lobby will be happy with equal recognition on par with heterosexual marriage status I see no problem with that. Let em eat cake I say. I mean really it is just a piece of paper.

As far as the moral degradation of our Judea/Christian culture I find this argument to be somewhat shallow coming from some of my Christian brethren. If you know biblical history (which I do) you know that "taking a wife" meant no more than taking her to bed and having sex. You did that and you were married in God's eyes. No paperwork,blood test no pre-nup, thats it, do the freak nasty and you were married.

I know the passage that states "men laying with men is an abomination to God" too so spare me all the amateur bible lessons please . Believe me if it is that big of a deal to God he will take care of it when the time comes. There is also a scripture about being "busy bodies" in everybody else's business. I'm sure this includes their bedrooms too.

My concern is with the true motive that may be involved here. Like I say if the gay lobby is happy with their new found legal status that's great. They should be able to have all the legal advantages of a hetero couple. Even any tax advantages should be fine with a true conservative. I'm all for gettin' over on the gov. no matter what your sexual preference is.

However... If I hear one goddamn gay get up and start harping about our countries long deep seated history of discrimination against them and our moral duty as a nation to pay reparations due them then Fuck It! I'm finding me a Klan hat and pitch fork and I'm commin' after ya.... Are we straight?

fuck this, let gay people get married. who the fuck cares? its NOT the role of the government to control what happens in peoples bedrooms. i'm more of a conservative person, but this is one issue i think we should put to rest. republicans are SO blind when it comes to this issue. why are we spending so much time and money on something that's already a constitutional right? fuck this, there are more important things to focus on, 2, almost 3 wars. immigration. the war on drugs... ect. the goverment needs to STFU and just get out of the way, and deal with issues they're suppose to deal with.

My take is this- give the same sex couples civil unions or some type of legal recognition that wwill protect them in medical events or in division of estates. Let the states define marriage.

While that is great fear mongering those arent the facts before the American public. And there is no need to set policy based on the some 1 in a million instance that might upset even 98% of the people. But the facts are even in the instances you mention..that if 2 brothers want to live in a committed sexual relationship...they will..and nothing can stop them. Now it's just a matter of what legal rights they have as a commtted couple...and I for one see no reason to make life any more difficult for them.

The bottom line is people dont have the right to take rights away from others just because it makes them uneasy.

The rights were not taken away, they were never granted. And you are right, people will do what they want. I've argued the same for years about drugs, gambling and morality laws- these things are hardly policed anyway and if you know what you are doing, you'll never be in any trouble.

It's a theoritical reach, no doubt. But if you would be accepting of some odd,incestous configuration like mentioned above being granted the privelige of marriage, you win the King of Tolerance Award.

Now let me ask this- I know it sounds like a red herring of an argument- but if there was a "married couple" brother/brother, father/son, whatever, would you be comfortable with them receiving the same recognition as you and your spouse? Would you have problems with someone married to his own brother teaching your child in school? Would you be wrong if it weirded you out?

While I don't believe gay marriage will bring about the apocalypse the way a lot of the Religious Right make it out to be, I can sympathize with Wingnut's position.

Theoretically speaking, if gay marriage was allowed, then polygamists can start complaining about being discriminated against, then the weirdos that want to marry family members will come along, etc. Redefining marriage can be a slippery slope.

I think polygamy is absolutely disgusting, and they will surely demand rights when homosexuals are allowed to marry.

I think it should proceed on a state rights basis. Let California lead the way and if Oklahoma and Alabama see it doesn't destroy the world, they will follow suit in a decade or so.

I just think civil unions are the way to go. You can't force a church to sanctify a marriage just like you can't bring a hockey stick to a basketball game and expect to play. The state should not tell a church what it should do or vice versa. Really the state probably should have very little involvement in any marriage to be honest.

First..delineate the "recognition" that you feel should be withheld from these people. There are many legal rights I would give to any self proclaimed couple...and a ceremony and a piece of paper recognizing that relationship is fine with me.

The only truly significant "recognition" in my marriage is the one between my wife and I. I really dont care what the rest of you think of my marriage..and I dont want you telling me what it is my wife and I can do in bed...in the living room...kitchen....public school..hospital. And I think those rights should be given to all...unless it can be proven that giving those rights to someone impacts anyone but them. So far, that case hasnt been made.

The difference between gays marrying and relatives marrying is that relatives are already related and as such have those benefits (medical events and division of estates) instilled by default (you know, the whole next of kin type of thing).

Personally, I have no problem with relatives getting married as long as they don't have kids and if they really want to have kids, they certainly don't need to be "married" for that to happen anyway (see West Va).

Just because something is weird to one person, doesn't make it any less legitimate in the eyes of the constitution and ones civil and human rights. I think Glenn Beck is weird and I would prefer he never have children, but I don't have the right to make that call and I shouldn't.

Let's be honest here, we all know what this is really about.

Because in my opinion, you are asking the residents of a state to sanctify,honor or give a "vote of confidence" if you will to the relationship. I don't have a huge problem with that, but because of remote and rare case like I mentioned (and polygamy like eesh mentioned) it seems pretty obvious that society does have and want some kind of standard.

Now ask the supporters if they are willing to accept the polygamy, the incestous etc etc. If they don't have a problem, they are true believers and while I disagree, I respect that. If they waffle, and many will, it proves my point.

I'm an atheist turned agnostic, not a bible thumper at all. But I wouldn't want my son to marry another man or his brother or sister, and I wouldn't want the state to force me to glorify it.

The hardline liberatarian view is that the state shouldn't be involved in ANY marriage, which is starting to sound more logical.

Once you go down the path of civil unions (and I don't have any beef with them in general) it opens the door to throw out all restrictions on who and how you are considered "married". If we are to believe that civil unions have nothing to do with religious practice, and are not bound by them - then things like polygamy are perfectly legal. Incest is no longer an issue, as it only arises from religious values and some concern over potential biological issues. With the number of birth defects we have today I don't see how this is any more worrisome to be honest. Then you have the whole issue of the rights of children - if we are going to allow children to have sex with other children prior to the age of 18 and not complain about it, then children having sex with adults is really not an issue either, nor would children marrying adults with appropriate consent. Once you remove all the religious connotation from the whys and hows of marriage, the rest of it is just legalities being redefined.

If marriage cannot be constrained to be between one man and one woman, then it cannot be constrained by much of anything with the proper legal consent.

Consent issues are not defined in a vacuum. If everything becomes a civil issue, then religion should play no part in determining consent age. And if we all agree that children (under 16-18) already consent to have sex between themselves and there is generally no legal consequence, then you will probably see that challenged in the future as well when determining consent for other purposes.

The one problem I would have with someone elses polygamy (i'd never marry more than one myslef) is the breadwinner issue. If a man marrie 3 or 4 women, can he really support them all?

I heard years ago that Mormon women with children in Utah get more welfare per capita, but I'mm not sure if it's true and I'm too lazy to google it. Wouldn't seem like a good idea to encourage multiple partners with huge broods of kids if the father could die and leave them all poor.

yes marriage needs to be defended. Around 40% of caucasian babies are born out of wedlock. 70% of African American babies are.

Nationaly, a first marriage has a 43% chance of seperation/divorce within 15 years. Conservative states have a much higher divorce rate than "liberal" states, sometimes twice as high.

Maybe the gays can do a better job at it.
