The Rittenhouse defense team filed a motion for dismissal with prejudice due to prosecutorial misconduct. The motion details how the state withheld high def video from the defense until after presentation of evidence had closed. Instead, Binger provided low-res video of the incident to the defense team but used the high-def video in his case. In fact, Binger tells the jury, "I have a better version", which shocked the defense team.
Add to that Binger's assault on Rittenhouse's 5th amendment rights (usually an automatic dismissal but not necessarily with prejudice), which the judge admonished Binger for but only took the defense's demand for an immediate mistrial "under advisement".
Is this how the state resolves the failed case? Throw it out on a technicality to spare the jury the violence of the mob?
