WASHINGTON—The police officer who shot and killed Ashli Babbitt during the Jan. 6 riot at the U.S. Capitol won’t face federal criminal charges in connection with her death, the Justice Department said Wednesday.
Federal prosecutors examined video footage on social media, interviewed the officer and other witnesses, gathered evidence from the scene and studied autopsy results, officials said.
“Based on that investigation, officials determined that there is insufficient evidence to support a criminal prosecution,” the Justice Department said in a statement announcing the closure of its probe.
The Wall Street Journal reported in February that investigators had made an initial determination that the officer, a lieutenant whom officials haven’t publicly identified, was acting as a last line of defense between rioters and members of Congress and shouldn’t be charged with any crimes.
Ms. Babbitt, who served for more than a dozen years in the Air Force and Air National Guard and became a passionate supporter of former President Donald Trump, died after being shot by a Capitol Police officer after rioters smashed through a door to the Speaker’s Lobby on Jan. 6. She had entered the building as part of a crowd aiming to disrupt the certification of President Biden’s victory in the 2020 presidential election.
