What I don't get is why she resigned instead of letting them fire her. If she was going to sue them anyway, why not try to get them for wrongful termination as well?

As I was saying about individual property rights and business ownership....

I would have let them terminate me, so I could file that type of lawsuit.

But...isn't it implied that if your line of work is based upon some degree of physical appearance (model, stripper, Hooters waitress), that your appearance could be a condition of employment? Similar to female soldiers, fire fighters or police officers - there is a certain level of physical fitness you need to maintain.

You don't see female accountants, day care providers, lawyers, nurses, etc. being terminated because they're "overweight", because it has no bearing on their ability to do their job or bring in business. A fat stripper or Hooters waitress isn't exactly what the establishment is trying to put out there.

EDIT: Just be semi decent looking and stupid and you'll be fine.

Some of them at the Fairfax Hooters are college students and actually quite
intelligent and they happen to like Hooters because it pays much better than working tables in a plain old restaurant.

Yeah, but physical fitness can be measured, like being able to run a certain distance in so many minutes, or how much you can lift at one time. This is all about physical attractiveness and losing job security because of it.

I don't know what type of fat woman would want to work at Hooters. I'm sure her tips were shitty.

I've only gone in Hooters a few times; the last time I went was at the Fairfax Hooters two waitresses were flirting with a midget. He seemed to be a regular; no joke, I made sure it will be the last time I set foot in that chain.

He probably is a regular and tips well. They're nice to everybody and
just because you perceived they were "flirting" may have just been good
customer relations. They sometimes flirt with me too but we know it's
just bs. I'd flirt back but my wife won't let me. :)
