Cary beat them in court, they tried to appeal, lost the appeal. Illegal police procedure and a damn good lawyer, end of story. Goto the damn courthouse and read the case if you're that interested.

that shows that they dismissed the appeal...he didn't win shit. also Nolle Prosequi doesn't bring into effect the double jeopardy law. he could still be charged after the decision in august 2010 and was brought up on charges in november of that year.

The question is why.
The answer may or may not be in the court papers. In my understanding, a prosecutor does not need to state a reason for a nol pros, but maybe VA practice is different.
