In a major win for the Trump administration, the Supreme Court issued an order late Wednesday ending a nationwide injunction by Tigar (Obama appointed Judge) that had blocked the White House’s ban on asylum for anyone trying to cross the U.S.-Mexico border by transiting through a third country.
THIS IS ONLY SIMPLE LAW AND TIGAR SHOULD BE DISBARRED FOR NOT ALREADY HAVING DONE IT
1) if there is a standing law it stands until changed. Trump's "policy" is to follow existing law it was Obama "policy" that should have been challenged (and was, by conservatives)
2) even if there were no law the CONSERVANCY STANCE is the default stance: meaning if a law is allowed to be challenged and an action by one side would ir-reversibly do something that cannot be undone, a stay motion is allowed to prevent that side from taking those ir-reversible actions - which is immigration without legalization. once they are in it creates a huge burnden on the court in the case they need to be "recovered" and that includes, likely, incriminating them as they will evade detection: and that fact there tells you which side of the case is "lying"
(note: it's by no means a "total or big win", california and elsewhere will no doubt continue on as they please, quash any local cases against themselves, use congress to end cases against them, all illegally of course)
