Federal judge rejects Trump administration’s bid to swap out lawyers for Census case on citizenship question

A federal judge in New York on Tuesday denied a bid from the Justice Department to replace the team of lawyers on the case about the census citizenship question, writing that its request to do so was “patently deficient.”

The department had earlier this week announced its intention to swap out the legal team on the case, without saying exactly why.

A person familiar with the matter said the decision was driven in part by frustration among some of the career lawyers who had been assigned to the case about how it was being handled, though the department wanted to replace those in both career and political positions.

But U.S. District Judge Jesse M. Furman denied the formal, legal bid to do so.

“Defendants provide no reasons, let alone ‘satisfactory reasons,’ for the substitution of counsel,” Furman wrote. He also noted that a filing in the case was due from the department in just three days, and that the department had previously pushed for the matter to be moved along quickly.

“If anything, that urgency — and the need for efficient judicial proceedings — has only grown since that time,” Furman wrote.

SCOTUS did not say the question was unconstitutional. All the Trump administration had to do was give an honest, plausible reason for needing to put the question on the census. Roberts would have let Trump do it. What does the Trump administration do? They lie, when they had no legal need to. Every court that looked at it said it was a lie. And Roberts decided that a lie used as justification was the same thing as no justification at all No question on census, case closed.

It is Trump's own people who are at fault for not having the question on the census. But here is the best part. If/when Trump comes up with a new explanation, the Courts are going to look at it very closely, cause Trump has already lied. To the federal courts. They don't much like that

If I believed that the census question was necessary(no opinion expressed), I would be pissed. But not at the libs. Elections are supposed to have consequences. It is a shame when you are too incompetent to carry out your agenda

But, no matter. They did, and they got caught, making things much harder in the future. They may get it anyway, but if they don't the responsibility is on them.

gee 'I wonder why they needed to lie?' Sell your BS elsewhere. Neither you nor a staff of dozens of lawyers has been able to come up with a plausible reason for including the question. Its all a real mystery huh?

Funniest part is those poor lawyers that wanted to eject from the case will be stuck arguing some absurd next lie to a judge that is holding them to their earlier claims this has to be settled immediately - they cannot even buy time here.

Judge has their number, they are toast, this will be resolved in a week. Its possible Trump could issue an executive order but that will be immediately challenged in court and I would say impossible to uphold after this much deception from the Administration.

In the unlikely event Trump won on the basis of executive order, it is past the point were the Administration said it was possible to include the question.

Any attorney who has litigated any length of time understands what is going on here. The attorneys who are counsel of record, if they attempt to "reverse course" or continue to pursue the groundless claims and positions of the Trump administration, risk the imposition of court penalties, and possibly the loss of their license by the state in which they are barred. Federal Rule 11 (civil procedure) provides that a district court may sanction attorneys and/or parties who submit pleadings for an improper purpose or that contain frivolous arguments or arguments that have no evidentiary support. This is clearly what is going on here.

Similarly, nearly all states have codes of ethics that have similar standards for professional conduct, the breach of which may result in penalties up to and including the loss of one's license. As we continue through to the end of the third year of this administration, it is clear to any sane, decent attorney that their reputations, their professional credibility, and their integrity -- not to mention their licenses -- will be lost, if they continue to support Trump's lies.

Trump may hoodwink his fawning supporters with his lying, but I can guarantee you that he is not fooling the federal bench.

One other thing to keep in mind. Trump has been hurling insults at the federal bench since before the 16 election. I have tried to warn him about it, but he is either too stupid, too dense or both. to get it.

You do not insult the federal bench with impunity. This is not over yet.

The GOP needs to cut the judiciaries budget by 20% and let them stew on that for a couple of years. Maybe cut the salaries of federal judges to $50K a year.

I love it. Go for it, it will get you everything you want.

Or maybe you should maybe get your Leader to stop lying. Especially when he gets no benefit from it. Things can actually get done when the job is performed by minimally competent people. Depends on what you want, and how bad you want it.
