It’s illegal to falsify or skip a census question. But SCOTUS already decided that Trump’s question couldn’t be added.

So even if Trump somehow forces it onto the form, people can really skip it or just lie. The executive branch can’t really enforce it. Anyone accused of lying or omission would have lawyers cite the SCOTUS ruling, and the feds aren’t prepared to file all those kinds of charges knowing full well that SCOTUS decision is law.

Scotus didn't make a ruling. They sent it back to treasury to try a different way.

A executive order is a completely different avenue.

Like Obama and DACA executive order.

Trump is just pulling an Obama method that works.
