Need insurance claims advice?? Please help.

My father got into a car accident this week. This other driver claimed it was my father’s fault. My father claimed it was the other guy’s fault. Fairfax County Police was called and the officer took one look at the accident and said it was obviously the other guy’s fault. So far, the other driver is being a total asshole and has refused to report the accident to his bullshit insurance company that nobody has ever heard of. The bullshit insurance company has refused to do anything until the asshole reports the accident, so we just get the run around. My father has been car-less for 5 Days now. His car will probably be totaled and is not safe to drive. The hood could fly open at any moment. What recourse do we have?? This is ridiculous. We have the Officer’s badge number and contact info. Thanks.

Shouldn't your father's insurance company be dealing directly with the other guy's?

My father has GEICO, but liability only so they don’t care.

It shouldn’t matter because the Fairfax PD said he was not at fault.

The other insurance company is a no-name Pennsylvania bullshit insurance company. Not even sure it’s legit. It has a 3 out 5 rating according to Google.

You and your dad made the decision to save money with liability only. I assume the vehicle is only worth a few thousand anyway. Go to the police station and ask for a copy of the accident report and a statement from the officer stating it was the other driver's fault. Get 3 written assessments of the cost to repair your vehicle. Submit these to the other driver and their insurance company registered mail return receipt. State you will give them 30 days to pay up or you will go to small claims court. If you know a lawyer or want to shell out 500 bucks have them send the letter.

Sorry these things happen. I had a person total our volvo when our Aupair was driving. Same sort of BS insurance company lying about whose fault it was. We had coverage and totaled the car. We lost $$$ on the deductible and increases in our rate.

Buy decent insurance and you never have to deal with stuff like this. In a situation like this I would never even attempt to discuss it with anyone outside of a courtroom. I would have a rental car immediately and my car would be repaired by a high quality body shop, it would have almost no impact on my life. Lesson learned OP.

LOL, you are probably the typical Fairfax County asshole with the BMW Lease you can barely afford and you are required by BMW Financial to have max insurance coverage or they will take your 1-series away. Nobody gives a shit!! People with real wealth own their cars and can buy whatever the fuck insurance they want asshole.

How many times do we have to go through this same BS? The other guy's insurance company is under no obligation to settle with your father unless and until you go to court and get a judgment against their insured. It does not matter whether the police officer says it was the other guy's fault. It doesn't matter if the court finds the other guy guilty. It doesn't matter whether twenty nuns with 20-15 vision saw the whole thing and will swear it was the other guy's fault. The reason you carry collision is so you don't have to deal with the other guy's insurance.

Most insurance companies will settle property damage only claims easily. The cost of fighting them is usually high relative to the damages, the amount of the damages is relatively certain, if they dick over an insurance company on one claim the other insurance company will respond in kind when the situation is reversed. And pissing off the driver makes it more likely the driver may find those minor aches are something more, and file a personal injury claim. If you don't have your insurance company standing up for you they have more reason to try and dick you over.

You contact their insurance company so they are on notice of your claim and can't weasel out of covering it if you get a judgment. You also ask them to make arrangements to inspect the car so they cannot claim evidence spoilation. Then if they aren't willing to talk settlement you get the car fixed, have the repair person do the affidavit and then file a suit against the other driver. That simple.

If your father cannot afford to fix or replace the car without the insurance settlement he should be kicking himself for not having collision. Harsh but true.

Oh I'm not single but this is a strange situation. No one has the right to force you to sign something without your consent. I took out life insurance because of my family, I care about the future of my children. In general, if you have questions about life insurance, it's best to go to these guys lifenetinsurance.com , they are professionals in their field and they answer any of your questions about insurance. After all, this is a rather serious question. which I think it is better to solve with specialists.
