Eli Lake - who has been following the media talking points has finally cracked a little bit. He rather disingenuously states:

The standard for senior officials to learn the names of U.S. persons incidentally collected is that it must have some foreign intelligence value, a standard that can apply to almost anything. This suggests Rice's unmasking requests were likely within the law.

So Lake is revealing that Rice and the Obama administration will argue that they had a legitimate reason to spy on Trump and his staff. Of course, he makes no comment about whether it is also lawful to leak this information to the media.

But he can't deny the obvious:

But Rice's multiple requests to learn the identities of Trump officials discussed in intelligence reports during the transition period does highlight a longstanding concern for civil liberties advocates about U.S. surveillance programs.

Indeed, much about this is highly unusual: if not how the surveillance was collected, then certainly how and why it was disseminated.


Lake is full of BS though because he himself says that:

...the reports said they contained valuable political information on the Trump transition such as whom the Trump team was meeting, the views of Trump associates on foreign policy matters and plans for the incoming administration.

This is nothing short of outrageous. Nixon never did anything like this.

Rather predictably no one is denying anymore that Trump, Trump staffers and family were targeted for surveillance. The defense machine is already at work. The story is now being put out that this spying was justified.

So let's be clear. Everyone is now admitting Trump and his campaign have been spied on for over a year. But it's OK.

I hope for the sake of our country they don't get away with it.

Rice’s denials don’t add up. It is hard to fathom how the demasking of multiple Trump campaign and transition officials was not politically motivated.

My guess is that Rice’s demasking requests were on behalf of the Obama National Security Council and were part of a broad campaign that began in early 2016 to abuse U.S. intelligence to hurt the Trump candidacy and then his presidency.

It wouldn’t surprise me if former Deputy National Security Council Ben Rhodes was deeply involved in this campaign.

Unmasking of the information and names does not cause it to become unclassified.

So the spurious argument that the unmasking was legal still does not apply to the subsequent leaking of the unmasked information and the names of American citizens.

The disclosure of classified information remains a felony punishable by 10 years in prison under 18 U.S. Code § 798.

In all, government officials conducted 30,355 searches in 2016 seeking information about Americans in NSA intercept metadata, which include telephone numbers and email addresses. The activity amounted to a 27.5 percent increase over the prior year and more than triple the 9,500 such searches that occurred in 2013, the first year such data was kept.

The government in 2016 also scoured the actual contents of NSA intercepted calls and emails for 5,288 Americans, an increase of 13 percent over the prior year and a massive spike from the 198 names searched in 2013.

The searches ultimately resulted in 3,134 NSA intelligence reports with unredacted U.S. names being distributed across government in 2016, and another 3,354 reports in 2015. About half the time, U.S. identities were unredacted in the original reports while the other half were unmasked after the fact by special request of Obama administration officials.

Among those whose names were unmasked in 2016 or early 2017 were campaign or transition associates of President Trump as well as members of Congress and their staffers, according to sources with direct knowledge.

Most of the surveillance was done legally by our friends overseas who are allowed to spy on us and share information. They are actually obligated to share information. The Brits and the Australians have been feeding our people information about Trump camp and the Russians long before he announced he was running for President.

This information was part of what was presented to a FISA judge to get warrants.

A couple of months ago the head of the Australian version of the CIA, traveling to the US on a diplomatic passport, was cavity searched at LAX airport. You can't do that, and they did.

The former top FBI official assigned to special counsel Robert S. Mueller III’s probe of Russian interference in the 2016 election was taken off that job this summer after his bosses discovered he and another member of Mueller’s team had exchanged politically charged texts disparaging President Trump and supporting Hillary Clinton, according to multiple people familiar with the matter.

Peter Strzok, as deputy head of counterintelligence at the FBI, was a key player in the investigation into Clinton’s use of a private email server to do government work as secretary of state, as well as the probe into possible coordination between the Trump campaign and Russia in the 2016 election.

During the Clinton investigation, Strzok was involved in a romantic relationship with FBI lawyer Lisa Page, who worked for Deputy Director Andrew McCabe, according to the people familiar with the matter, who spoke on the condition of anonymity because of the sensitivity of the issue.

And let’s not forget, Clapper’s report on Russian involvement with the DNC hack and WikiLeak’s was the foundation of the fake “Seventeen Intelligence Agencies have concluded Russian hacking on behalf of Trump” talking point that emanated from the Obama Administration, was parroted by the Clinton campaign and became a montra of the New York Times, AP, CNN and most mainstream media outlets until they corrected their own record earlier this year.

Was the August 2016 decision to spy on a Trump associate based on a Clinton campaign screed’s claim of a corrupt Trump-Russia deal? Did FBI and Justice Department officials lose their professional objectivity because Steele’s information fit their anti-Trump bias? Was the Steele dossier, in effect, the “insurance policy” Agent Strzok had in mind? President Trump can provide the answers to these questions: He just needs to order the FBI and Justice Department, led by his appointees, to cooperate with Congress’s investigations.
