Except there was no child pornography found by Sensei. What Sensei had "found" was a list of website URLs from a browser history, on a disc that had allegedly been wiped -- NOT child pornography. There was none: zero, zilch, zip, nada. Claiming child porn was found is misinterpretation at best, and deliberate libel at worst.

There are many ways that URLs can get into a browser history, and the site need not even be loaded for that to happen. Compromised websites can do this, as can viruses and malware. Some antivirus programs can block a malicious site from opening yet it will still show in a browser history. The domains need not necessarily even have an active website. Furthermore, there are other technical limitations to using a browser history to establish dates, times, and computer user. Beyond that, even visiting a site, for example Fairfax Underground, does not prove an individual downloaded pornography from it.

The most important and troubling aspect of this incident is the fact that when Basl turned over his computers for examination, he did so with an expectation of privacy, that any information collected would only be used as evidence in the lawsuit and that his data would remain confidential. Obviously that did not happen, as the Morenos posted the report and their wild accusations here on Fairfax Underground.

It appears that the Morenos violated a signed non-disclosure agreement when they posted the information on a public website. That goes counter to numerous ethical and legal rules of evidence. If eesh had had an actual attorney representing him, the Morenos would very likely be facing sanctions and contempt charges,

The bottom line is, there was no child pornography found on eesh's computers, regardless of what Sharon Moreno may claim.

If Basl wishes to pursue a civil or criminal case on this matter, I am willing to serve as an expert witness and will place my experience and credentials against Sensei any day of the week.
