Judge David Carter refused to hear Obama’s request for dismissal today, instead setting a hearing date for Oct. 5, since Obama’s attorneys had just filed the motion on Friday. He indicated there was almost no chance that this case would be dismissed. Obama is arguing this lawsuit was filed in the wrong court if you can believe that. I guess Obama would prefer a “kangaroo court” instead of a Federal court! Assuming Judge Carter denies Obama’s motion for dismissal, he will likely then order expedited discovery which will force Obama to release his birth certificate in a timely manner (if he has one).

The judge, who is a former U.S. Marine, repeated several times that this is a very serious case which must be resolved quickly so that the troops know that their Commander in Chief is eligible to hold that position and issue lawful orders to our military in this time of war. He basically said Obama must prove his eligibility to the court! He said Americans deserve to know the truth about their President!

Even if this judge hangs tough, it will get appealed to the 9th circuit, i.e., the most liberal federal appellate court.

The case will be lost there, certainly, and the Supreme Court will not touch it.

Whether or not he was born in Hawaii, there's something embarassing in that birth certificate (the original) that he doesn't want people to see, else he would have revealed it. The litigation may bring that to light. But he will not be removed from office. No way. The Supreme Court will not depose a president elected by some 50+ million voters. There are several legal strategies for avoiding that result even if, ex hypothesi, Obama is not a natural born citizen.

I'm sure you've already considered that, if the second one is the birth certificate that Obama got from Hawaii, then that's the type of birth certificate that all Hawaiian statesmen are using (which would make it a valid document, acceptable for use in verifying one's citizenship).

Do us a favor; when you're 46 years old, call up the hospital you were born at. Ask them to send you the original copy of your birth certificate that was written up when you were born. Let us know how long they laugh at you.

I do not like Obama, but saying he's not eligible to be president because black people come from Kenya (and even worse, wasting the court's time with petty, unfounded lawsuits) is stupid and ignorant. Obama could produce a picture of the doctor who delivered him signing his original birth certificate under a neon sign that says, "OBAMA HAS BEEN BORN IN HAWAII," and the birthers would say it was staged.

Why not focus your passion and drive into an area of politics that might make things better?

To my knowledge, Obama has never said he lost the original. It wouldn't surprise me if he did, given the peregrinations of his youth, but so far as I know he's never claimed that.

Dude, re-read my first post. I'm not that invested in this thing. I do find it mildly interesting, particularly the possible legal arguments I referred to; I would be intrigued to see them fully fleshed-out in litigation. But as I said, the bottom line is there's no way any court is going to is going to depose Obama. So it's not a battle I'm interested in fighting. If others are, that's their prerogative; that's why we have a judicial system. If you think they're wasting time and energy that would better be invested elsewhere, that's not an unreasonable position. My own view is, if they want to fight it out in court, let 'em fight it out in court. Better their energies are directed towards litigation, or non-violent protest, than some other, less socially desirable strategy.

The only point of discovery is to determine if there is enough evidence to overcome reasonable doubt. The fact that Hawaii has provided Obama's birth records, the Republican Governor of Hawaii is on record as having reviewed his birth records and says they are legit, there are two birth announcements in newspapers in 1961 and the fact that Orly Taitz and the Birthers have produced ZERO evidence to back up their claims, odds are this whole thing will be thrown out in a few weeks.

By the way, Orly Taitz and the Birthers sounds like a great name for a college band.

That still doesn't answer why the President did everything within his legal power to prevent from having to bring forth the aforementioned documents in an actual court of law. He is hiding something, and although I won't go so far as to claim that it has to do with his place of birth, there no less is something on that document that he doesn't want exposed.
