Lizzie's crack legal team mounted a temporary insanity defense, which if successful would have gotten her off of all three possible charges for assault: malicious wounding, unlawful wounding, and even assault and battery. Obviously, despite four hours of testimony from a quack shrink for the defense, the jury was not buying it. Their decision indicates they didn't buy the insanity defense (which was probably done in by the jail phone call tapes between lizzie and eesh) and also that they found misery a credible witness (this all especially considering she did not testify). The only thing that saved lizzie from many more years of prison was that the jury apparently could not find that the wounding was necessarily malicious, so she was found guilty of unlawful wounding instead. It does however speak volumes that they threw the book at her in regards to the brandishing charge by giving her the absolute maximum of 12 months in jail for that offense.

I can't say, if I were on the jury, I would be able to find beyond a reasonable doubt that the wounding was malicious either, so in all fairness, I think they did an admirable job of assessing the situation and not buying the bullshit the defense was selling.

Tip to those awaiting trial behind bars: all your phone calls are monitored and the contents of your conversation may be used against you in a court of law. So, if you feel like bragging about your crime to some deadbeat with a 1.4 million dollar judgment against him and filing for bankruptcy.....write it down and send it in a letter instead.

I am quite fascinated with the entire lizzie drama, but never have time to go to couort and check out the festivities.

You may recall, the assault occurred on the same day she returned from the state nut hut. She was under some delusion that, having been rejected as not insane by the nuthut, she would subsequently be turned loose. This did not happen - she was taken back to the ADC for re-processing. On arrival, she chimped out and tried to make a break for the exit - when the guards tackled her, she punched one in the face. She had to be tazed six times. Contrary to popular belief, no poo-flinging was involved.
