FDA Announces Rule To Ban 99 Percent Of E-Cigarettes

The Food and Drug Administration (FDA) published long-awaited rules Thursday that could ban 99 percent of e-cigarette products and wreck industry innovation for years to come.

Passed in 2009, the Tobacco Control Act says all e-cigarette products released after February 15, 2007, (predicate date) will have to go through the Pre-Market Tobacco Applications process (PMTA). FDA officials claim they cannot change the predicate date.

The PMTA is ruinously expensive and can cost millions of dollars per product and by the FDA’s own admission will take more than 1,700 hours for an applicant to complete.

Since almost all vapor products on the market were released after February 2007, hardly any will avoid a PMTA and almost no businesses, with the exception of big tobacco companies, will be able to bear the regulatory burden.

“The agency’s economic analysis of the rule predicts that the cost of such approvals will be so high that approximately 99 percent of products on the market will not even be put through the application process,” says the American Vaping Association (AVA).

The rules usher in a new era of federal regulation, with sales of vapor products to those under the age of 18 banned nationwide. Most states had already passed laws banning e-cigarette sales to minors.

“This final rule is a foundational step that enables the FDA to regulate products young people were using at alarming rates, like e-cigarettes, cigars and hookah tobacco, that had gone largely unregulated,” Mitch Zeller, director of the FDA’s Center for Tobacco Products, said in a press release. The FDA will now set industry standards for manufacturing and labeling. The rules will take effect in 90 days.

Burwell called the regulations "common sense" actions to protect children from tobacco products.

"As a nation we have agreed for many years that nicotine does not belong in the hands of children," Burwell said during today's new conference. "Progress has been made but the context has changed, we owe it to ourselves to do better."

Zeller said his group is working with state officials on plans to enforce the ban on sales to those under 18 and that they will "hit the ground running."

They can't regulate shit. They're going to learn the hard way. This is a process the government is going to go through on this. If they make it too difficult for independent vendors to meet safety regulations they will create an unnecessary work around illicit market. People will just sell the flavors of their juice separately. Just mix them once they get to you. They going to ban food flavorings?

Big tobacco can't corner this shit. I'm not worried about it. They are just trying to create a standard for its production which is a good thing. As long as they don't over do it to drive mom and pop shops out of business who built the industry.

Because it typical progressive libtard regulator fashion the regs are written in a very broad way that goes beyond e-cigs in particular to regulate nicotine and nicotine delivery devices more generally including e-cigs, pipe and hookah tobacco, cigars, etc., in order to protect us from the dangers of nicotine addiction.

Also, the Feds and B.H.O want to look the other way when it comes to marijuana. I knew a guy who smoked pot everyday from his teens to his early 40's. He checked out at the age of 44 due to throat cancer. These idiots from Colorado, Washington, Oregon etc.will have health problems down the road. Thank god for Obama Care.

it was and is already illegal to addict children to nicotine


infact the tabacco industry owes me and others money for:

#1 distribution of tabacco in elementary school to addict minors - sending tobacco company agents to schools to distribute tobacco as part of "the curriculum"

#2 distribution of tabacco to minors out of vending machines in public places

if it were for the fact many other states sued my state for "tobacco lawsuits" and spent the money on anything but "medical care for smokers". so infact it is many states that owe me.

but saying FCC or FDA under obama has been strict is a laugh. every commercial for drugs quickly says the drugs side effects are far worse than its supposed relief. every day we see another lawsuit ad saying "if this drugs side-effects killed you or your dying, call 1800-your-fucked-you-fell-for-it"

Vapers are a movement. They don't fuck around. They quit cigarettes and think they save lives. They are a brotherhood, a community. They have money, prosperous business and are more organized per capita than any other industry on the face of the planet.

They are going to sue the living fuck out of the FDA. It will take over a decade for this law to be enforced but I doubt a judge won't intervene and provide more protection to vendors.

Yeah some regulation is good but trying to give the industry to big tobacco is not right. It is an industry brought up from the ashes to kill tobacco. It's fundamentally wrong to hand it over to those assholes.

Not really. By far the greatest healthcare costs for almost everyone come later in life and especially near end of life. Smokers tend to die off younger and relatively quickly. The ones who really drain the system and run up the costs are those with chronic long-term illnesses over long periods of their lives who are an exception but expensive, people 70+ who start to fall apart and develop a variety of illnesses, and mostly the old women who hang on forever in nursing homes. You can look at the Medicare numbers to see where the money goes by age. It's greatly skewed at the high end with those 80+ accounting for 1/3 of the spending even though there are fewer of them.

As counter-intuitive as it might seem, at least at a macro level in terms of lifetime healthcare costs, smokers actually kind of do us all a favor.

You're right it can't be regulated. It's impossible. It's very easy to make. The only reason some people don't do it is because they buy gourmet mixed flavors instead. If they can't regulate e-juice. What are they going to do? Regulate lithium batteries? Wattage regulating chips?

That's all it is. And a coil made of wire heated up between two points. Its simplicity will defeat any attempt at over regulating.

You don't even need a chip to vape very high wattage.

All you need is a high amperage lithium battery and a sub ohm resistance wire between its negative and positive posts. Bam you are vaping. All you need is a battery and a wire.

I could make a home made vape device right now from just a battery, some wire and a metal tube.

The FDA doesn't even seem to be proposing testing. They want the companies to do the testing and the FDA will interpret the results they are given. What could go wrong.
