Bar exam pass rates vary from state to state and sitting to sitting. In some states 45% fail the first time. In others only 25% fail. In some states the February fail rate can be as high as 70 or 80%.

I'm not sure, but I thought that only the top scoring x% get admitted to the bar, so you could do OK, but if you are in a test session full of geniuses, you could still not be admitted.
I don't know (but I would hope) that there is a minimum score that could pass in any case.
I guess I would need more context for "fail" in this case.
Don't get me wrong, I wouldn't vote for her to be dog-catcher-in-training.

Posters are wrong to list Cardozo among those having failed the bar exam. This pernicious canard has been posted and reposted many times in the past few years. (Bar prep expert Joseph Marino blogged as recently as October 22, 2015 that Cardozo “failed several times.”) The truth is contained in Andrew Kaufman’s biography, Cardozo, at p. 54: young Benjamin applied for admission to the New York on June 26, 1891, as soon as he turned 21. He was duly examined and was admitted on October 26 of that year. Now it IS true that Cardozo dropped out of Columbia law school without earning a law degree, but that’s another story (told at p.49).

Both Bill Clinton and Richard Nixon were disbarred. Not abig deal though, because few former presidents with law degrees ever return to the practice of law.
DC Bar used to have the reputation as being extremely difficult to pass. The common approach used to be to get admitted in another state and then waive into the DC bar. It was so common that if you saw on the letterhead that an attorney was admitted to practice in DC and PA, you assumed he'd passed the Pennsylvania bar and then waived into DC.
