Jamycheal Mitchell, a mentally ill 24-year-old, was found dead in his cell at the Hampton Roads regional jail in Portsmouth on Wednesday, August 19, after spending nearly four months in custody.

Mitchell was arrested on April 22 after stealing a bottle of Mountain Dew, a Snickers bar and a Zebra Cake worth a total of $5 from a 7-Eleven.

Following his arrest, Mitchell was held at the Portsmouth city jail for almost three weeks before being transferred across the city to the regional jail on May 11. Ten days after his transfer, Mitchell, who suffered from schizophrenia and bipolar disorder, was judged not competent to stand trial and was ordered to be committed to the Eastern State hospital in Williamsburg for treatment.

However, Mitchell was never transferred to the hospital and stopped eating and taking his medicine.

Jamycheal Mitchell's memorial service was August 26, so they've already paid for the funeral. They're just looking to recoup their costs at this point.

Also, the GoFundMe fundraiser was started by Jenobia Meads, Mitchell's cousin, and not by his sister Jasmine.

Question: If he was so loved by his sister and family, why did they leave him in the jail when they knew he needed to be hospitalized. They didn't go see him in 4 months? I can't imagine the bail on a $5 shoplifting charge would be more than maybe $250.

With such an extensive arrest record, I'd wager the bail was much higher than 250$. Also you've got shit taste because his sister is a 8/10 at worst.

The aunt said relatives had not been able to visit Mitchell because he had not given jail officials their names as approved visitors.

As far as bail goes, the judge didn't set bail, and instead ordered Mitchell to be transferred to Eastern State Hospital in Williamsburg.

Since the mental health system for poor people is completely overwhelmed, no bed for Williams ever became available. He stopped taking his meds, he stopped eating, and since he didn't tell anyone he was on a hunger strike and wasn't a behavioral problem, the guards didn't notice that he was starving to death.

The family (or more likely, Mark Krudys, the family's lawyer) then shopped the story around, likely to drum up public sympathy for whatever wrongful death lawsuit they will shortly be filing.

The complication is that Mitchell was mentally ill, and prisoners do have the right to adequate medical care while they're incarcerated. There's also the question of how Jamycheal was able to starve himself to death and not one guard noticed there was a problem until he was a skinny corpse on the floor of his cell, which sure sounds a lot like negligence.

As it stands, the Hampton Roads Regional Jail Authority is going to have to spend several tens of thousands of dollars defending against a lawsuit, and likely have to pay a couple hundred thousand dollars more in whatever settlement they cook up to make Krudy and Jamycheal's family go away.

I originally wrote that Jamycheal didn't get bail, but a report at PilotOnline says that his bail was set at $3000.

Since you have to pay 10% of the bail to a bail bondsman to spring someone, that means that his family could have gotten him out for $300.

It's most likely they did not have $300 to spend on bailing Jamycheal out, but it's also possible that no one in his family wanted to spend $300 getting him out.

The PilotOnline article also makes it clear just how crazy Jamycheal was:

A forensic psychologist evaluated Mitchell to determine whether he was competent to stand trial. The psychologist said Mitchell was "manic and psychotic" during the interview. "Mr. Mitchell's thought processes were so confused that only snippets of his sentences could be understood, the rest were mumbled statements that made no rational sense," wrote Evan Nelson.

Mitchell twirled around the visitation cell, rapped, spit on the floor and exposed himself, Nelson wrote.

Jamycheal had also been evaluated in 2010 as "acutely psychotic" and "unrestorably incompetent to stand trial".

And of course, Jamycheal had a dream of being a rapper.
