UNARMED white man shot twice in the back by black cop

Authorities said a New York State Police sergeant -- identified as Jay Cook -- spotted Sweat, and after Sweat ran, the sergeant gave chase.

"At some point, running across a field, he realized that Sweat was going to make it to a treeline, and possibly could have disappeared, and he fired two shots," New York State Police Superintendent Joseph A. D'Amico told reporters.

Sweat, who was unarmed, was hit twice in the torso. Authorities described his condition as stable.

I was wondering... What are the legalities around this? I didn't think they could shoot a fleeing suspect.

Y'know, hooray that they didn't let the escaped killer get away, but what are the "official" rules about this?

It is permissible to shoot a fleeing felon if they are considered a threat.
This is a perfect example. Escaped convicted murderer of a police officer=take the shot if you can.

Do they have to be felons? Is there a specific type of threat they have to pose? I would have thought the criminal would at least have to be armed...

Escaped serial rapist/killer/cop killer yes.

This was discussed on CNN yesterday. The attorney said that New York State has a law on the books that police can use "deadly force" on a "convicted fleeing felon".

SO, KUDOS TO THE COP!!!!

EVEN MORE KUDOS TO THE COP THAT KILLED THE FIRST ESCAPEE. THAT ESCAPEE WAS SHOT 3 TIMES IN THE HEAD! 3 TIMES!!! THAT'S FUCKING GOOD SHOOTING THERE TO HIT SOMEONE 3 TIMES IN THE HEAD! NOT A BIG AREA TO HIT ESPECIALLY WHEN THE FIRST SHOT WOULD JOLT THE PERSON BACKWARDS!

I think it has to be a VIOLENT fleeing felon before they can legally unload a clip into your back. Makes sense.

I talked to a couple of people who didn't understand it, thought it was fighting dirty.

I wonder what NYS has as far as a "castle doctrine"? Could you bust caps in these two if they were on your and or breaking into your home without violence?

I have to wonder if citizens are allowed the same leeway the cops are. With a douchebag like Cuomo running the ship, I would doubt it.
