I agree, I've been reviewing the cases and it appears that neither one of them have much substantial facts, enough to warrant a conviction. These backyard attorneys that post here with what they perceive as relevant factual material has no bearing. They rehash items posted here years ago and feel that the Judge will be so impressed that he will allow it to be entered. Prediction: Both cases dismissed. Attorneys fees will remain.

good, glad to hear it. Dont really know what to say regarding the lawyer fees which I am sure at this point are fairly substantial, but I'm sure they both deserved their hourly

Oh Yea!! Hundreds of dollars an hour, a lot more than a plumber makes which is big bucks in itself. Well both eesh and misery can chalk it off to "lessons learned'. In cases like this only the lawyers make out, they are probably on the phone with each other now laughing at the clowns they have as clients.

You all seem to be forgetting that the Misery FAMILY never posted anything here and were direct targets anyway. Their home and vehicles were tampered with because of some guy on the internet who took it offline and this isn't the first time he's been accused of such a thing by a family from this site. Strange how Eesh goes by people's homes and suddenly theif property gets damaged. It goes much further than the cyber world and apparently Misery was arrested on some bogus claim that Eesh made so again, it stopped going into the cyber world and very well warrants the courts getting invovled.

Doubt if the OP "Actual Lawyer" is one. There are lots of reasons why cases are set far out - schedules and need for extensive discovery being just two of them. Also, there aren't a lot of 4 day jury trial slots on the Fairfax Circuit court calendar. Also, no lawyer would make the statements that the OP makes about the Plaintiffs. Lawyers don't talk about clients not "handling the witness stand". I doubt very much that the Moreno's attorney is worried about Eesh's cross examination skills. The OP is probably eesh anyway.

Misery should have realized that his posts could have possible reverberations on his kin, the good name of the Moreno family. Plus the fact that he posted from his parent's basement adds to the responsibility of "internet responsible posting, in any crime or malfeasance isn't it the innocent that suffer? I kinda feel for Miz though because his friends (Tuttle and Alias) instead of talking to him as a friend should, just enabled the behavior, perpetuating the post. The real authors in my opinion are his fly-by-night friends (so-called).

Still doesn't jistify going after the family. They didn't post any of the garbage their son posted and probably weren't aware.

Burden of proof in a civil case is only 51% too. They don't even have to prove beyond a reasonable doubt, especially when there are documentations of Eesh even saying he was driving up to Misery's home around the time the alleged crime happened.

Yep. If Misery says that eesh did it, it's good enough. The police couldn't find any evidence that eesh did it, they never found reasonable suspicion to arrest eesh, but Miz's lawyer will find evidence, whether it exists or not.

No way, impossible to prove a negative. The burden of proof is on Miz to come up with something substantial, a picture, witnesses, something concrete. There is none of that there, eesh has relatives in that area, maybe he went to visit them. eesh know in his heart of heart he didn't do it. His word versus the word of another. I predict the Judge's final words will be something like: "Look we are never going to get to a solution, I suggest we........"

As you can see from the evidence, eesh intended to be in Sterling the same day the washing machine broke and flooded the basement. How could a jury not believe the damning evidence? From eesh's posts, a reasonable person could believe (51%) rule) that eesh broke into the Moreno home, vandalized a pipe until it froze to death, and flooded the basement.

The harrassment claim made against Misery happened after this lawsuit was filed.

How is this lawsuit frivolously made in an effort to prevent Eesh from proceeding in a criminal trial against Misery if these claims Eesh made against Misery happened after?

Also, if these claims were true, nothing would have prevented Eesh from proceeding in a case against him. Unless the claims were bogus and that's why the protective order has been thrown out.

Eesh posted the lawsuit thread on Jan 27. Misery was arrested Feb 2 and the offense made Feb 1.

How would the lawsuit against Eesh be made to stop Eesh from going after Misery for a crime that hadn't even occurred yet?

That's wishful thinking on your part to think anything has been "blown" because of that one thing compared to all of the other things stacked up against Eesh. I once again say that even if Eesh did do that, it wasn't illegal and isn't a crime and they aren't asking for anything in return for that.

i Have just come across this page after googling our street address. our house is under contract to be sold and i along with my father were curious to see what some websites had our house listed as. So i came across VEXXED who is supposedly Greg Wales. I have also read numerous posts slandering my father, my fathers picture, my fathers property and so on. I also put two and two together and reslized why an odd thing happened to my father last year. We got a phone call at 11pm from a police operator asking on the welfare of my father, Apparently someone called into the emergency line and told them my father 'Greg Wales' was suicidal.We assured them that was not the case and it has to be a mistake. My father was in bed asleep. The police had to come and make sure all was well. They awoke my dad up out of a deep sleep. Which in turn woke my children up(all 6 of them) and scared the crap out of us all. Who would do this? we asked ourselves. My dad has no enemies. My dad knows many people and all who know my father, even if they know him from only a brief meeting, would say whoever called must not know Greg Wales or they called in on a different "greg wales'. No one would prank the police and say my father was suicidal, no one at all. well guess what? i now know why and i know the few people that would call the police and tell them 'Greg Wales'was suicidal. We have found the need to file charges as soon as the police determine who the caller was we will have thier name and will be able to file charges. the cops on the other hand have thier own investigation for identity theft and Filing a false Police report.

Obviously no one knows for sure who posted the thread about Chuck's kid, but there are a couple things we do know:

-eesh on many occasions has used Chuck's MINOR daughter as a means of bullying chuck (well documented in many threads).

I'll do a quick tl;dr to this, someone (Eesh?) calling in as "Greg Wales"(Who is Vexxed) said that they were suicidal. This didn't lead to a swatting, but the cops came.

This screams Eesh. Eesh attempted to swat vexxed as Vexxed outed him.

This is Eesh calling in these swats or he is being framed.

Only Eesh has the time to stalk Vexxed and find out who he is and attempt to Swat in retaliation because he got outed by Vexxed.

i Have just come across this page after googling our street address. our house is under contract to be sold and i along with my father were curious to see what some websites had our house listed as. So i came across VEXXED who is supposedly Greg Wales. I have also read numerous posts slandering my father, my fathers picture, my fathers property and so on. I also put two and two together and reslized why an odd thing happened to my father last year. If you do a search, eesh is the only person besides those threads who mentioned the truck. At LEAST 15 times. It's called morbid jealously. He is an extremely envious person, which is why he made so many threats against the truck and was so obsessed with it and it's location.
