There seems to be little evidence except for the posts and the note under the wiper. And some posts are said to be eesh or another poster. He will lose, the question is how much will it cost.

I really want to read it but it's sooo much..so what are they trying to do? Have him put in jail or seeking money and for the harassment to stop? I would just settle and leave those people alone. There are cases where people have legally been stopped from using the net. We know eesh could not handle that, it would be worse than any jail sentence. Based on the facts presented, he is going to end up with about $125,000-$175,000 due in damages if his own lawyer is good enough to argue the unsubstantial findings.

There's way too much evidence and far too many other people who could testify again him. They were smart enough to actually include things that eesh admitted himself, like going to their home, leaving notes on vehicles, not just the swatting.

Having an obviously unstable person drive over 100 miles for no real good reason to your home is enough alone to cause some distress. Add that in with the violent posts eesh makes and his obsessive nature with other people here, you've got yourself a case.

I'm surprised no one did this sooner. I guess the Moreno family has the money. But how stupid could you be that you would ever admit to the police that you went there in the first place?

They do have you for putting the note on the car. The detectives will back him up on that when the lawyer calls on him. If there is a jury, that will help win them over on the information and belief part. Another thing that will help them is when they read back and of your many threatening posts and pictures.

I never got into the eesh/Misery battles. The "real world" things eesh did were dumb and probably some of it illegal (if he in fact did them).

But I don't feel bad about Mr. Misery, and his family should be blaming him for the consequences they suffered. If he was living at home they should have cut off his Internet access WAAAAYYYYY early in this process. They should be too embarrassed about their son's behavior to sue someone else.

When I hear "Mr. Misery" only two things pop into my head... his posts about wanting to have anal sex with a baby, and his posts calling 9/11 an "accident" that should be celebrated. These are disturbingly callous things to say even if it was supposed to be a joke. If you post things like that you may anger people. Mr. Misery was a part of the problem and I believed asked for negative responses. I'm not saying vandalism is justified, but I am saying that you can't control the consequences of posting things like that.

They claim eesh framed them into a SWAT visit, who is to say they didn't frame eesh with vandalism and a "note"?

Please. Andi Geloo's lawsuit didn't do jackshit-it was delayed and her attempt to find the ips and identities of the FFXU posters were quashed. Nobody, not even her coworkers take her seriously.

Virginia’s sanctions statute, Virginia Code § 8.01-271.1, requires that every “pleading, written motion, and other paper” in a case be signed by an attorney.

The signature acts as a certification that, among other things, there is a well grounded factual basis for each assertion in it, based on the signer’s belief “formed after reasonable inquiry.”

If a paper is signed in violation of this requirement, then the court can sanction the person who signed it, or his client, or both.

Note that the statute does not require that the assertions be in fact true, or even that they must ultimately be proven at trial. The only requirements are that the signer must believe them to be well grounded, and that that belief must be based on a reasonable inquiry.

This is the Virginia equivalent of federal Rule 11, with one key difference.

The federal rule has a “safe harbor” provision, giving a lawyer 21 days within which to withdraw a challenged document, and thereby avoid any possible sanctions.

Virginia law doesn’t have that; essentially, as soon as you file or serve a paper that violates the statute, the “offense” is complete and you’re subject to being sanctioned.

He's correct about the statute, and you shouldn't put a lot of faith that "upon information and belief" means they won't have the goods on you. That language is used by attorneys all the time. What's going to happen in this case is that the plaintiff's lawyer is going to issue discovery - to you and to other persons, to get information to prove that you in fact did the things that are alleged in the complaint. If you did do those things, or something close to them, it will almost certainly be proven "by a preponderance of the evidence", which is the legal standard that will apply. The fact is, if you did these things, you're going to get a judgment against you, probably in a large amount.

what are my odds of getting a reckless driving ticket reduced(going 83 in a 70)

I was polite as shit and have no points, what's the maximum charge it could be reduced to?

I have no fucking idea what the "odds" are. For one thing, I do civil, I don't do traffic or criminal. For another, lawyers who have half a brain don't give "odds".
