Let Obama challenge it to the Supreme Court. Keep us safe should be the governor's highest priority.

Rick Perry would be down.

I don't think it would pass the Constitutional test, but why not try and let the courts sort it out?

It would be a great way to showcase how America fucked up electing this jug eared jagaloon.

Also politically, if the Republicans did this, they would destroy the democrats next months.

I am fairly certain that you'd run into constitutional problems with that. Interstate commerce, interstate travel, Federal supremacy on who is permitted to travel into our out of the U.S.

Yes, but a legal challenge buys time. Governors can declare states of emergency with emergency powers. Is anyone in that state going to fight it??? Obama
and Holder will only look like even bigger idiots if they challenge it on constitutional grounds. Of course, looking like idiots has never stopped them before.

it figures the teabaggers would come up with an idea that makes no sense just to tie up the court system, simply because they hate the U.S. President. that seems to be their only response to dealing with things these days.

Punkass Obama did selective enforcement on deporting illegals, medical marijuana and on enforcing the Bill Clinton DOMA.

Now I don't care about the weed and gay marriage laws, but if somethings on the book it should honored.

I think it would be a great idea to put it Obama's face and block West Africans immigrating to some of the states.

Make Obama and his next asshole AG fight it out in court, or look like pricks by sending federal troops.

Governors do have the power to restrict entry into their states of people with infectious diseases. Stopping flights from landing probably not, but they could stop the people themselves from leaving Federal property/entering their state.

The Federal government already has the power to do the same and is supposed to enforce it against various listed diseases like smallpox, etc. This has been done in the past by us any other countries and was considered to be a perfectly reasonable response to minimize the potential spread for things like pandemic flu, SARS, etc. The only reason that some are questioning the efficacy of travel restrictions now is that Obama says no. So all of the partisans fall in line and parrot the same. Whether it's actually effective in this case or not is an entirely different matter.

If you ever drive between CA and NV or AZ, there are sometimes agriculture inspections. I can't remember if they are fed or state, but it's a similar concern to stopping diseases.

Obama and Holder are agitators of the lowest moral caliber. They proved they were more concerned about PR and appeasing their racist base in the Zimmerman and in the Micheal Brown case. They will bandstand and accuse anyone of acting sensibly of being racist.

I lived in the SF Bay Area and coming back from Reno, NV there was a checkpoint asking you if you are bringing agriculture products into California.

Those same checkpoints could ask if you've been to West Africa and check your papers regardless.

Was it USDA doing it or CA state agriculture?

It would make more sense to do this at the airports, but without cooperation from the feds and the main entry points, JFK, ORD, LAX, ATL, DFW it's not a 100% protection.

Current authority:

Quote

Under section 212(a)(1) of the Immigration and Nationality Act, any alien who is determined to have a communicable disease of public health significance is inadmissible to the United States and ineligible for a visa. The 42 CFR Part 34 regulations defines the term communicable disease of public health significance and describes the medical examination that aliens must complete in order to determine whether they have one of these diseases.

[The definition of "alien" includes both immigrants, refugees, those seeking asylum, and nonimmigrant persons from another country coming to the United States as a temporary visitor either for business or pleasure. Basically anyone applying for entry into the US.]

What diseases can currently prevent non-U.S. citizens from coming to the United States?

As of January 2009, diseases that can prevent entry to the U.S. fall into three categories:

- Any of the following diseases: active tuberculosis, infectious syphilis, gonorrhea, infectious leprosy, chancroid, lymphogranuloma venereum, granuloma inguinale and HIV infection [HIV now removed from list].

- Quarantinable diseases designated by any Presidential Executive Order. The current list of diseases includes cholera, diphtheria, infectious tuberculosis, plague, smallpox, yellow fever, viral hemorrhagic fevers, severe acute respiratory syndrome (SARS), and influenza caused by novel or re-emergent influenza (pandemic flu).

- Diseases that are reportable as a public health emergency of international concern to the World Health Organization under the International Health Regulations of 2005. These diseases currently include polio, smallpox, SARS, pandemic flu and other public health emergencies of international concern.
