You won't be able to see how much time he got but he was found guilty of only the felony 3rd dwi. It went to jury, if you search the prison locator he's still in Fairfax lock up. He may have just gotten 1 year.

He would stay in the ADC. Usually you serve half the time, so 1 year with 6 months suspended, and he has been in there for quite a while already. Hopefully he got 3 years with half suspended, so if he fucks up again he will have to serve it all.

It means that the General District Court is done with his case. Frisky's next stop is the Grand Jury, which will rubber stamp the indictment and issue a true bill, then trial in Circuit Court.

Of the 6 charges, the Commonwealth's Attorney nolle prossed 5; all of the misdemeanors and 2 of the 3 felonies. This is pretty standard; the CA files a big pile of charges to try to force the defendant to plead guilty to one or two of them and drops the rest.

It's still possible that Frisky will get a deal similar to inkahootz', where he was allowed to plead to a misdemeanor with a long jail sentence instead of a felony. (Inka was charged with DWI: 3rd, but plead to DWI: 2nd.)

Regardless, he's probably going to be in jail come the new year.

Fuck man. He's been in there since what? Mid March of this year? So Probably 6 1/2 to 7 months at this point. lol. At least his ass has had some time to dry out and sober up a bit. He was almost certainly in the midst of a huge binge when he got arrested so getting him off the street at that time was good for the public.

Some people get really stupid when they drink and clearly Frisky is one of them. What kind of idiot decides to go around driving on a revoked license when he's drunk as shit, knowing that he's already got a pair of DUI's to his name AND knowing how tough VA is on this sort of thing?

Some people are just incapable of using common sense when they start drinking. At that point it falls on Big Brother keep them off the street cause they're just too stupid to behave themselves. Sad.

He hasn't been convicted yet. All the time he's served so far has been waiting to appear before the District Court judge, who certified the case to the Grand Jury. What that means is that the judge thought there was enough evidence for the Grand Jury to review the case and see if Frisky should go to trial.

The worst case scenario is that he gets the full freight for the single felony he's got left, which is 5 years in prison. Since Virginia doesn't have parole any more, he'd have to do 85% of that sentence, or 51 months.

While it gives eesh pee-pee tingles to think of Frisky being in prison until 2018, his own recent experience with the criminal justice system should provide a more realistic perspective.

Note that the reporting agency is the Virginia Department of Corrections, which likely means that Frisky's either copped a plea or was found guilty at trial (I don't care enough to go to the courthouse and find out.)

Likely what they're doing is allowing him to serve out his sentence at the ADC. Although they could just be getting ready to transfer him downstate, that'd be a waste of time and money if he's only got a few months to go.

The plea bargain system seems to place too much power in the hands of the CA (or DA or ADA) to game the charges to get a particular result, effectively making him or her the judge and jury.

It seems like the triumph of expedience over justice (although in many particular cases, justice or some reasonable facsimile thereof is likely served); and it leaves a tremendous amount of leeway for abuse in the event the charging attorney is less than scrupulously ethical. And what percentage of attorneys are scrupulously ethical (as distinguished from sufficiently ethical to avoid malpractice claims and/or trouble with the bar)?

Assuming that human nature precludes any realistic possibility of a perfect system, yet always leaves room for improvement, should the plea bargain system be reformed, or even overhauled?

Can it be reformed, given societal pressures to maintain expediency?

Does the risk of making things worse, via ill-considered rather than wise reform - with ill-considered reform seemingly commonplace at the institutional level - suggest that if the system ain't (completely) broke, don't fix it?

I just tried to check and post it but it wasn't available. The 3rd DWI / 5 years says to check circuit court case information, and then I went there and there was no option to select Fairfax County for circuit courts...?

You have to have a paid subscription to Fairfax County's Court Public Access Network (CPAN), which costs $50 per month, in order to check for Circuit Court cases online. Getting a CPAN account involves a ridiculous application process that requires you to have all the subscriber agreements notarized (for an indidual, this is three separate documents). See http://www.fairfaxcounty.gov/courts/circuit/cpan.htm

Fairfax is one of the only counties in the Commonwealth that hides its online Circuit Court records behind a pay wall.

If you don't want to pay, you have to go to the Courthouse to look up the records.

This is one of those times where it would have been nice to still have a complete loser like eesh with nothing better to do than to go fetch the court records. I'm not sure he's able to afford the gas money anymore.
