Virginia can charge. Under Federal law the U.S. can have the case transferred from a Virginia to a Federal court. Once the case lands in Federal court the U.S. or the defendant can claim that under the Supremacy Clause the case must be dismissed. The U.S. Supreme Court long ago recognized that state criminal laws could be used to prevent Federal officials from carrying out their lawful duties, and when this happens the state charges must be dismissed.

Dismissal requires a finding though that the Federal officer's actions were lawful, or more specifically that "a federal officer [must do] no more than is necessary and proper in the performance of his duty". The Federal officer's actions are generally necessary and proper when he "reasonably believed that his actions were necessary to perform that job and had no motive other than to do his job". Where Federal law enforcement officers shot persons who had surrendered into their custody, the courts have ruled that the state can prosecute those Federal officers.

This is where it gets interesting. In the Ruby Ridge case, Idaho v Horiuchi the Federal officer/sharpshooter claimed the charges should be dismissed because he was trying to prevent Harris from harming law enforcement officers when he shot and killed Vicki Weaver. The Federal trial court accepted officer Horiuchi's representation and dismissed the Idaho charge under the Supremacy Clause. On appeal though the Court majority ruled that where the facts are in dispute. Therefore the trial court should not have simply accepted officer Horiuchi's representation that the shooting was proper. Instead the judge must hear evidence and determine whether the officer's conduct falls within the scope of the Supremacy Clause. If so the prosecution can go forward.

So Virginia can charge, the case then gets transferred to Federal court, and once there the U.S. or the officers would have to present evidence showing the shooting was proper. If they failed to do so then Virginia could try the officers.

The want to pull him over for a fender bender. Understandable. But at the end, when the officers are NOT in danger, they shoot repeatedly into the vehicle. The video doesn't lie. It actually looks like the man is shot and his foot comes off the brake, vehicle moves slightly, then the last round of gunshots by the police.

That last round of shots was totally unnecessary. The officers were not in danger at that time, the vehicle was not pointed in their direction.

He was Persian. Persian is an ethnic majority in Iran, while Iranian is a Nationality. Iranians speak Persian Farsi (at least the majority). Arabic is an ethnicity, and Arabic is the language of that group.

He was a United States citizen and the Park Police murdered him because that's what cops do.
