Had all the limbs of a huge pine tree cut off, but only on one side of the tree.

The tree didn't belong to him, it belongs to the community But he paid to have these limbs removed.

The person who did the work was a Hispanic who also later did some high priced work for me. This Hispanic told me my neighbor wanted the tree trimmed because he was tired of the pine tree droppings on his vehicle.

What I can't understand is why this man, Cheryl, just didn't move his vehicle instead of destroying the tree. Cheryl was parking on the street anyway, he could have parked it any other place by his house. But I suppose he was so stuck
in one way of thinking that he was just focused on that tree and nothing else?
This guy is from WV, but he seems to lack common sense.

My neighbor has since said he never told this Hispanic to trim the tree as he did, probably because it wasn't his tree in the first place. My neighbor doesn't know I have contact with the tree trimmer.

Do you think I should share what I know with the HOA, or not?

"Tree law" goes back to the middle ages and is so complex that the lawyers who know of it stay away from it and the lawyers that know nothing jump right in and THEN find out it so complex.

While I am not an expert, I can tell you that if a neighbors tree limbs encroach on your property, you have the right to safely them back to the property line. The owner of the tree, legally, has very little responsibility to trim the tree. This is true under most circumstances.

If a neighbors tree falls on your house, you are responsible - not the owner of the tree. This holds true unless you notify the neighbor in writing beforehand that the tree poses a threat.

You reserved parking space is your property, sort of. So if a tree is dripping sap on your car, the argument could be made that you are allowed to trim it back.

Do not get me started on tree roots. Those laws are really complicated.

One of my neighbors received a letter from an attorney demanding she cut the branches of a tree on her property that was encroaching on his client's property.

The letter demanded they tree owner trim the tree or the client would have hire someone to do it and the tree owner would be responsible for the bill.

Since the tree owner of the tree was an elderly woman on a fixed income, I sent a copy of the letter and a brief explanation of "tree law" to Fairfax County Bar Association. The tree was trimmed by the lawyer's clients and we never heard from them again!

I love lawyers!
