Jackson Browne Vs John McCain

It what can only be described as a typical Republican "shoot first and ask questions later" tactic, Mr. Browne is complaining that his song "Running on Empty" is being used by the McCain campaign in commercials attacking Mr. Obama.

The Supreme Court has ruled that using celeberties likeness in trade without their permission, violates the celeberties right to publicity. You can take a picture of Jackson Browne drinking a coke and sell it to your friends, publish it in a newspaper, whatever you want - but if it is in advertisement for coke, then it is a violation of his right to publicity even though he was using the product.

Furthermore, using a song without obtaining the proper license is a big no no except in a very limitted "fair use" capacity. Look for a RNC rep to deny any wrong doing by saying it was a local issue (in a big swing state, Ohio!) and they did not know permissions was not granted.

As it is very easy to verify whether license to use the song had been granted. Hey RNC - Running On Empty is Ascap Title Code: 480119413 and published by

And Jackson Browne Managemnt is Donald “Buddha” Miller and Cree Clover Miller. I have met Budha years ago and he was a nice guy and sure he would glad to assist he RNC in any question about licesure rights to Mr. Browne's music.

In a related or unrelated note, Mike Myers has also protested with the McCain camp for using his likeness and Waynes World character in the McCain celeberity ad.

Did anyone ever think to ask "is this ok to use" or did the RNC plan to use the "whoops, sorry we won't do it again" approach they are famouse for?

These two have alot more in common than you think. One was a big hit back in the seventies and the other is a big hit in his seventies.

It's sort of funny the way these conservatives always pick songs written by liberal musicians (Browne, Springsteen, Mellencamp, etc.) They must be getting sick of the Toby Keith tunes, or they're trying to be "hip". And what says hip more than Jackson Browne.... ;/

Seriously, is that hard to not commit copyright infringement. These are the kind of folks McCain hires to run his campaign??

Sounds like a good theme song for Obama.

Just like Ronald Reagan didn't understand the lyrics of "Born in the USA" when he used it in 1984, McCain doesn't understand the lyrics of "Running on Empty." Maybe McCain should have chosen "Beautiful Loser" from Bob Seger. That is probably more along the lines of what he had in mind.

The band Heart immediately Sent McCain/Palin a Cease and Desist order on playing the song "Barracuda." The song was played when Sarah Palin joined McCain after he finished his speech at the Republican Convention.

Don't these idiot Republicans respect anybody’s rights and property?

I see an oportunity for Heart with new, updated lyrics; The best opportunity for Ms. Wilson to get new airplay since she went down the duet/soundtrack road back in the 80's.

By the way, it appears Heart has given permission for Governor Palin to use their 80's hit "Alone" whenever the Governor finishes a speech.

You nutjobs are going to make an issue of this? Nobody clamored when your savior used Brooks and Dunn's "Only in America," which the band played at Bush's inauguration. In fact, Kix Brooks released a fairly magnanamous statement: “Seems ironic that the same song Bush used at The Republican Convention last election would be used by Obama and the Democrats now. Very flattering to know our song crossed parties and potentially inspires all Americans.” Pretty kind considering the fact that the duo even played it live at Bush rallies in 2004.

Perhaps these other musicians should take a page from their colleague Kix Brooks and get a little thicker skin.

a search of BMI’s Web site shows that Kix Brooks and Ronnie Rogers co-wrote the song with Don Cook, a veteran songwriter and producer who has worked extensively with Brooks & Dunn.

Mr. Cook was active in the Music Row Democrats, a political action group of music industry professionals who opposed Bush’s re-election.

So, the Democrats' most likely had a friend on the songwriting team; the Kix brothers had to be tame.

Valen Halen has also objected to McCain's use of their song "Right Here."

I think if they need a replacement for the song Barracuda when introducing Sarah, the Republicans should go with "Run Joey Run" by David Geddes; it involves a pregnant girl,a gun, and a teenager wanting to get married-all themes in Sarah's message.
