Maybe you’ve taken a naked selfie for your significant other, or you’ve let someone take a photo of you in the nude. Once that kind of photo exists, it’s all too easy for someone to send or post it without the subject’s consent.

That’s what appears to have happened to hundreds of female service members, after explicit photos of female Marines and other members of the armed forces were found circulating online last week.

So what can you do if this happens to you?

First, preserve the evidence, says Carrie Goldberg, a New York attorney and a director of the Cyber Civil Rights Initiative, an advocacy group for people whose images were distributed without their consent.

That means: Take screenshots of the posts and relevant Internet search results for your name, and record URLs and messages. Save the information to a computer and print it out, the advocacy group says.

Then, consider the following avenues of redress:

Prosecution for this offense specifically
More than 30 states and the District of Columbia have laws against nonconsensual disclosure of sexually explicit images and videos. That number grew quickly – before 2013, just three states expressly prohibited it, says CNN legal analyst Danny Cevallos.

So you could seek prosecution for this specific crime in those states. But you and/or your lawyer should be prepared to be dogged about it.

“Because almost all the laws are so new, law enforcement are still getting the hang of how to apply them,” Goldberg said. “At our firm, we have so many cases where (complainants) go to law enforcement and are turned away, even in states that have the criminal law.”

Go to the police with your evidence and a copy of the law in your hands, Goldberg said.

“These cases require a great deal of advocacy,” she said.

The rules and penalties vary. Some states, like Arizona, require proof that the distributor intended to harm, harass, intimidate or threaten the alleged victim.

But proving the distribution itself is usually no trouble, Goldberg said.

“With the exception of hacking cases, 99% of the time victims know exactly who is responsible, and it’s very provable with IP (addresses), login, and other cyber forensic information,” she said.

It’s a misdemeanor in some states (in Alaska, the penalty is up to 90 days in jail and a fine of up to $2,000), and a felony in others (in Hawaii, up to five years in prison and a fine of up to $10,000).

If you and the perpetrator live in separate states, where should you pursue the case? You could do it in either, but there tends to be less foot-dragging if you take action where the offender lives because her or she is more readily available for arrest, Goldberg said.

Quandaries like these are partly why advocacy groups are pushing for a nationwide law.

“We are calling for legislation that makes it a federal crime to distribute a private, visual depiction of a person’s intimate parts, or of a person engaging in sexual conduct, with a disregard for a person’s lack of consent to the sharing,” the group Not In My Marine Corps said in a statement. The organization was recently started by a female Marine veteran to bring stories of harassment in the service to light.

Prosecution for other crimes
If your state doesn’t have a law against this specifically, you might seek prosecution for other, related offenses.

“Often, distribution of images is in the context of greater violence,” Goldberg said. “Sometimes the offender not only posts the naked picture but also threatens and stalks in other ways. He may be sending hundreds of text messages or showing up at work, threatening friends and family.”

“We see that revenge porn is just one tactic that’s used in a greater campaign of abuse,” she said.

Can a prenup for sex tapes keep you safe?

So preserve the picture evidence to help prosecute a larger harassment case, even in states that don’t have laws against nonconsensual porn sharing.

Civil lawsuits
At least 12 states have civil laws that pertain specifically to nonconsensual image sharing. But a victim probably could sue, in all states, for the intentional infliction of emotional distress, Goldberg said.

"Revenge porn" can ruin lives and cause much distress, according to Danielle Citron, who thinks it should be illegal.

Maybe you’ve taken a naked selfie for your significant other, or you’ve let someone take a photo of you in the nude. Once that kind of photo exists, it’s all too easy for someone to send or post it without the subject’s consent.

That’s what appears to have happened to hundreds of female service members, after explicit photos of female Marines and other members of the armed forces were found circulating online last week.

So what can you do if this happens to you?

First, preserve the evidence, says Carrie Goldberg, a New York attorney and a director of the Cyber Civil Rights Initiative, an advocacy group for people whose images were distributed without their consent.

That means: Take screenshots of the posts and relevant Internet search results for your name, and record URLs and messages. Save the information to a computer and print it out, the advocacy group says.

Then, consider the following avenues of redress:

Prosecution for this offense specifically
More than 30 states and the District of Columbia have laws against nonconsensual disclosure of sexually explicit images and videos. That number grew quickly – before 2013, just three states expressly prohibited it, says CNN legal analyst Danny Cevallos.

So you could seek prosecution for this specific crime in those states. But you and/or your lawyer should be prepared to be dogged about it.

“Because almost all the laws are so new, law enforcement are still getting the hang of how to apply them,” Goldberg said. “At our firm, we have so many cases where (complainants) go to law enforcement and are turned away, even in states that have the criminal law.”

Go to the police with your evidence and a copy of the law in your hands, Goldberg said.

“These cases require a great deal of advocacy,” she said.

At the time, Chan was working a “4x10” schedule. That means that she worked ten hours per day
Monday through Thursday and had Friday off. On Friday, 8/4, Chan came in to work on the day
that she was scheduled to depart (that evening) for military duty. She came in to work, trying to
comply with the Director’s order that she switch shifts with other employees to cover shifts that
she missed because of her military duties. She had only been at work for 15 minutes when the
Director sent her home, because she had already worked 40 hours that week (Monday through
Thursday) and the EEOC headquarters had not authorized overtime.
The Director gave Chan a written reprimand for “unauthorized changes to the work schedule,
unauthorized overtime, and discourteous behavior.” The Director also suspended Chan’s
teleworking privileges and her “4x10” work schedule. The Director never restored these revoked
privileges. Despite all these problems in 2017, the Director marked Chan as “fully successful” in
her annual performance appraisal in December of that year.
On 1/8/2018, the San Diego EEOC office received a written complaint from a charging party9
alleging that Chan had treated the charging party rudely during an intake session on 8/12/2017.
Chan could not have been guilty of this alleged offense. She was on military duty from 8/4/2017
until 8/17/2017. On the date of the alleged offense, she was far from the San Diego EEOC office.
The Director of the San Diego office communicated the complaint to Chan. On 1/24/2018, Chan
filed a written rebuttal with the Director, denying that she had treated any charging party
discourteously and pointing out that she could not be guilty as charged because she was away
from the EEOC office, on military duty, on the date of the alleged offense. In her letter to the
Director, she stated that she hoped that the accusations against her were not retaliation against
her because of her military service, and she asked to be treated like the other investigators in the
San Diego office.
Between 2/15/2018 and 3/26/2018, Chan received five sets of orders from her new USAR unit,
directing her to report for short tours of military duty in Arizona, California, Hawaii, and Texas.
Four of these orders were eventually revoked by the Army.
8 Under section 4312(a)(1) of USERRA, 38 U.S.C. 4312(a)(1), Chan was required to provide advance written or verbal
notice to her employer before absenting herself from work for military duty, unless giving advance notice was
precluded by military necessity or otherwise impossible or unreasonable. 38 U.S.C. 4312(b). USERRA does not
require the individual to provide any specific minimum amount of advance notice, and Chan could not provide
notice to her employer before she had notice from the Army. The Army Reserve needs to do a better job of
providing advance notice to reservists like Chan, and the individual should be excused from any required training
unless the Army can provide at least 14 days of advance notice.

On 3/20/2018, Chan received three more sets of military orders. One order required her to
report for military duty on 4/20/2018. Chan immediately shared information about the orders
with the Director and the IS of the San Diego office.
At the very last minute, on 4/2/2018, the Army moved up the report date from 4/20/2018 to
4/3/2018, the very next day. Chan notified her EEOC supervisors as soon as possible, on the
evening of April 2, 2018.
10 Chan was on military duty and away from her civilian job from
4/3/2018 until 5/5/2018. After completing this period of service, she reported back to her job the
very next day, 5/7/2018. On that same day, the Director gave her a performance evaluation that
failed her on every element, and he put her on a Performance Improvement Plan (PIP) for 90
days. Chan was suspended without pay for two days (5/14 and 5/15, 2018), based on the
charging party’s written complaint that the San Diego office received on 1/8/2018.
On 5/23/2018, the Director again chastised Chan for her absences from work for military duty,
although those absences were protected by USERRA. On 9/11/2018, Chan received from the
EEOC the written notice of proposed removal from federal employment. She responded in
writing on 10/5/2018. On 11/7/2018, she received the Notice of Final Decision, firing her,
effective 11/15/2018. She filed her appeal with the Merit Systems Protection Board (MSPB) just a
month later, on 12/17/2018.

Overview
Defamation is a statement that injures a third party's reputation. The tort of defamation includes both libel (written statements) and slander (spoken statements).

Elements
To prove prima facie defamation, a plaintiff must show four things: 1) a false statement purporting to be fact; 2) publication or communication of that statement to a third person; 3) fault amounting to at least negligence; and 4) damages, or some harm caused to the person or entity who is the subject of the statement.

State-Specific Elements
Different states vary in their anti-defamation statutes. As such, courts in different states will interpret defamation laws differently, and defamation statutes will vary somewhat from state to state. In Davis v. Boeheim, 110 A.D.3d 1431 (N.Y. 2014), which is a New York state court case, the court held that in determining whether a defamation claim is sufficient, a court must look at whether the "contested statements are reasonably susceptible of a defamatory connotation." However, as the Davis court held, because the courts recognize the plaintiff's right to seek redress as well, many courts have declined from dismissing the case for failure to state a claim, as long as the pleading meets the "minimum standard necessary to resist dismissal of the complaint."

Burden Of Proof To Show Fault
Most states assume that a speaker who defames another necessarily has the requisite guilty state of mind. In Levinsky's, Inc. v. Wal-Mart Stores, Inc., 127 F.3d 122 (1st Cir. 1997), the court held that in Maine, all defamation claims need showing of fault, which requires the plaintiff to prove that the defendant was at least negligent.

Actual Malice Standard
In The New York Times Co. v. Sullivan, 376 U.S. 254 (1964), the Supreme Court held that for a publicly-known figure to succeed on a defamation claims, the public-figure plaintiff must show that the false, defaming statements was said with "actual malice." The Sullivan court stated that"actual malice" means that the defendant said the defamatory statement "with knowledge that it was false or with reckless disregard of whether it was false or not." The Sullivan court also held that when the standard is actual malice, the plaintiff must prove actual malice by "clear and convincing" evidence, rather than the usual burden of proof in a civil case, which is the preponderance of the evidence standard. On this point, the precise language the Sullivan court uses is that the plaintiff must show "the convincing clarity which the constitutional standard demands."

Privileges and Defense
Complete Defenses
Truth is widely accepted as a complete defense to all defamation claims.

An absolute privilege is also a complete defense to a defamation claim. Among other examples, this includes statements made by witnesses during a judicial proceedings.

Qualified Privilege
In the defamation context, a qualified privilege permits someone to make a statement that would typically be considered defamatory, but because of particular circumstances, a particular statement made would not be considered to be defamatory. However, if the statement is made with actual malice, then the speaker will no longer be entitled to the qualified privilege.

Among other examples, this includes statements made during legislative proceedings.

Defamation in California – "When can I sue someone for it?"
To establish a defamation claim in California, you must prove four facts:

That someone made a false statement of purported “fact” about you:
That the statement was made (“published”) to a third party;
That the person who made the statement did so negligently, recklessly or intentionally; and,
That as a result of the statement, your reputation was damaged.
California law recognizes two types of defamation: libel and slander. The main difference is whether a defamatory statement was made verbally (constituting slander) or in writing (constituting libel).

Libel is a form of written defamation.

1. The difference between defamation, libel and slander under California law
Defamation is an invasion of the interest in reputation. Under California law, it’s a broad term for false statements made that cause damage to someone’s reputation.

California Civil Code (Cal. Civ. Code) states that defamation is effected by either libel or slander.1 If a statement is made verbally, it is slander. If made in writing, it is libel.

Cal. Civ. Code §45 and Cal. Civ. Code §46 provide codified definitions for both libel and slander. Cal. Civ. Code states:

Libel is a false and unprivileged publication by writing, printing, picture, effigy, or other fixed representation to the eye, which exposes any person to hatred, contempt, ridicule, or obloquy, or which causes him to be shunned or avoided, or which tends to injure him in his occupation.

In some states, libel can sometimes be charged as a crime and be punishable by a fine and jail time. However, in California, people who have been defamed are limited to their right to recover damages in a civil lawsuit.

According to Cal. Civ. Code §46, slander is “a false and unprivileged publication, orally uttered,” that does one or more of the following:

Charges any person with crime…;
Imputes in a person the existence of an infectious, contagious, or loathsome disease;
Tends directly to injure him in respect to his office, profession, trade or business…;
Imputes to a person impotence or a want of chastity; or
Which, by natural consequence, causes damage.2
Unlike libel, statutory rules for slander carve out certain types of oral comments that are deemed injurious.

Again, both libel and slander are different types of defamation.

2. The elements of a California defamation case
In California, a plaintiff must prove five elements to establish a defamation claim:

An intentional publication of a statement of fact;
That is false;
That is unprivileged;
That has a natural tendency to injure or which causes “special damage;” and,
The defendant’s fault in publishing the statement amounted to at least negligence.
2.1 Intentional publication of a statement of fact
Since California law treats defamation as an intentional tort, a defendant must have intended the specific publication.

A publication means communication to some third person who understands the defamatory meaning of the statement and its application to the person to whom reference is made.

A publication need not be to the public at large. A communication to a single person is sufficient.

With regards to statements of “fact,” a large issue arises in the context of whether a statement was either a statement of fact or a statement of opinion.

In general, if a defendant stated an opinion, as opposed to a fact, then there is no defamation.3

However, a statement of opinion may still constitute defamation if it implies the allegation of undisclosed defamatory facts as the basis for the opinion. The main determination is whether a reasonable person could conclude that the published statements imply a provably false factual assertion.4

The determination of whether a statement expresses fact or opinion is a question of law for the trial court, “unless the statement is susceptible of both an innocent and a libelous meaning, in which case the jury must decide how the statement was understood.5

2.2 False publications
In California defamation lawsuits, plaintiffs must present evidence that a statement of fact is provably false.

If the person who made the alleged defamatory statement was telling the truth, it is an absolute defense to an action for defamation.

For example, if a person is spreading a rumor about another person, and this rumor is true, there is no defamation

In cases involving matters of purely private concern, the burden of proving truth is on the defendant.

A defendant does not have to show the literal truth of every word in an alleged defamatory statement. It is sufficient if the defendant proves true the substance of the charge.

In cases involving public figures or matters of public concern, the burden is on the plaintiff to prove falsity.

2.3 Unprivileged publications
A statement must be unprivileged to be actionable as defamation. This is also to say that a showing of privileged communication is a defense to a defamation lawsuit.6

California courts have codified several privileged communications in Cal. Civ. Code § 47. According to this section, some examples of privileged publications include publications made:

In the proper discharge of an official duty:
In a legislative or judicial proceeding;
By a fair and true report in, or a communication to, a public journal of a judicial, legislative, or another public official proceeding; and,
A communication, without malice, to a person interested therein, (1) by one who is also interested, or (2) by one who stands in such a relation to the person interested as to afford a reasonable ground for supposing the motive for the communication to be innocent, or (3) who is requested by the person interested to give the information.
The last example is known as the common interest privilege and it is a conditional privilege because it only applies to “communication without malice.” The privilege is lost if the publication was actuated by malice. Once the defense has demonstrated that the qualified privilege applies, the plaintiff has the burden of defeating it by showing malice.7

2.4 Injures or causes special damage
The fourth element in a California defamation action requires a plaintiff to show that a publication caused injury or “special damages.” When it comes to this showing, California defamation cases fall into one of two categories. These include:

Defamation “per se”
Defamation “per quod”
2.4.1 What is defamation “per se”?
In some defamation cases, the publication, or defamatory statement in question, is considered so damaging that the plaintiff is entitled to sue without having to prove actual damages.

Such statements constitute defamation per se under California law. Per se is a Latin term meaning “of itself.” Depending on whether the statements are written or spoken, this could be referred to as slander per se or libel per se.

California law has a broad definition of “per se” defamation. It consists of anything that is damaging on its face without further explanation.

Most “per se” cases occur when someone falsely accuses another person of having committed a crime or being unfit to practice the person’s trade, business, or profession.

2.4.2 What is defamation “per quod”?
In California, if a defamation case is not categorized as “per se,” it is defamation “per quod.” Per quod is a Latin term meaning by which or whereby.

If a defamatory publication is “per quod,” it means that the publication is not defamatory on its face and requires allegations and proof of special damages.

Examples of special damages might include (but are not limited to):

Lost profits;
Decreased business traffic; and/or,
Adverse employment consequences.
Defamation per quod cases demand the use of extrinsic evidence or explanatory information to show the libel or slander.

2.5 Fault needed in California defamation cases
As with any personal injury in California, the defendant must have acted with a degree of legal culpability for the plaintiff to be entitled to damages. However, the level of culpability required in a California defamation case depends on whether the plaintiff is a public or private figure.

When the plaintiff is a private individual, he or she is only required to prove that the defendant was negligent in making a defamatory statement.

A public figure, however, must prove affirmatively that a statement was false. He or she must also prove “actual malice.” This means that the defendant made the defamatory statement either with knowledge that it was false or with reckless disregard for the truth.

2.5.1 Who is a public figure under California defamation laws?
In California, to classify a person as a public figure, the person must have achieved such pervasive fame or notoriety that he becomes a public figure for all purposes and in all contexts. Some examples of a public figure under California law include:

An author;
A television personality;
The founder of a church; and,
A real-estate developer.
California law also requires “limited-purpose” public figures to prove malice in defamation actions.

A limited-purpose public figure is considered different than a public figure.

A limited-purpose public figure is a person who voluntarily injects himself or is drawn into a particular public controversy.8

As examples, the following persons have been considered limited-purpose public figures under California defamation law:

The president of two corporations that opposed rezoning issues affecting his property; and,
A self-proclaimed expert in earthquake safety.
A copy of the United States Constitution under a gavel.
The United States Supreme Court has long held that there is “no constitutional value in false statements of fact.”

3. What about my right to free speech?
The First Amendment to the United States Constitution protects the right of free speech. But, this right is not absolute.

4. Defenses to defamation in California
There are numerous defenses available in a California defamation case. Some have been touched on already. A few of the more common defenses include:

The defendant’s statement was true;
The statement wasn’t published;
The statement was privileged;
The statement was an opinion or fair comment on a matter of public interest;
The statement wasn’t made negligently or with malice; and/or,
The defendant never said anything negative about the plaintiff.

5. What may a plaintiff recover in a California defamation case?
If a plaintiff is successful in his or her defamation case, that party may recover damages.

In general, a plaintiff may be awarded three types of damages. These include:

General damages, which are damages for the plaintiff’s loss of reputation, shame, mortification, and hurt feelings;
Special damages, which are damages to the plaintiff’s property, trade, profession or occupation; or,
Punitive damages, which are damages awarded in the discretion of the superior court or the jury, to be recovered in addition to general and special damages, and to be awarded for the sake of example and by way of punishing a defendant.
The specific type(s) of damages a plaintiff may be awarded will most likely depend on the facts and circumstances of a given case.

6. How long does a plaintiff have to file a defamation case?
In California, a lawsuit for defamation must be commenced within one year.

The one-year period (the” limitations period” or “statute of limitations”) starts running when the plaintiff knows – or, in the exercise of reasonable diligence, should have known – about the defendant’s wrongful actions.

7. Related cause of action – false light
A false light claim in California creates a right to sue when someone knowingly or recklessly creates publicity about another person in a way that unreasonably places the other person in a false light.

In general, a plaintiff in a false light suit must prove the following elements:

The defendant published some information about the plaintiff;
The information portrayed the plaintiff in a false or misleading light;
The information was highly offensive or embarrassing to a reasonable person; and,
The defendant published the information with reckless disregard as to its offensiveness.
Public disclosure of private facts is a similar cause of action. A form of invasion of privacy, this tort occurs when one publically disseminates private or embarrassing facts about a person, without the person’s consent, and without a legitimate public concern for the topic.

While defamation is meant to protect a person from injury to his reputation, false light is meant to protect a person from the offense or embarrassment that arises from a misleading or untrue implication.

Revenge porn is the distribution of sexually explicit images or videos of individuals without their consent.[1] The material may have been made by a partner in an intimate relationship with the knowledge and consent of the subject at the time, or it may have been made without their knowledge. The subject may have experienced sexual violence during the recording of the material, in some cases facilitated by narcotics such as date rape drugs which also cause a reduced sense of pain and involvement in the sexual act, dissociative effects and amnesia. The possession of the material may be used by the perpetrators to blackmail the subjects into performing other sex acts, to coerce them into continuing a relationship or to punish them for ending one, to silence them, to damage their reputation, and/or for financial gain.

In the wake of civil lawsuits and the increasing numbers of reported incidents, legislation has been passed in a number of countries and jurisdictions to outlaw the practice, though approaches have varied. The practice has also been described as a form of psychological abuse and domestic violence, as well as a form of sexual abuse.[2]

The term "revenge porn" most commonly refers to the uploading of sexually explicit material to the Internet to humiliate and intimidate a subject who has broken off a relationship.[1] The term is also often misused to describe non 'revenge' scenarios, including nonconsensual pornography distributed by hackers or by individuals seeking profit or notoriety.[3][4] The images are usually accompanied by sufficient information to identify the pictured individual (a process known as doxing), typically names and locations, and can include risqué comments, links to social media profiles, home addresses and workplaces.[5][6] In some cases victims are exposed to workplace discrimination, cyber-stalking or physical attack. Some companies search the Internet for potential sources of bad publicity, resulting in many victims of revenge porn losing their jobs and finding themselves effectively unhirable.[7] Some academics argue that the term "revenge porn" should not be used, and instead that it should be referred to as "image-based sexual abuse."[8]

Jurisdictions which have passed laws against revenge porn include Italy, Israel, Germany, the United Kingdom, Canada,[9] 40/50 states of the United States—plus Washington, D.C.[10],the U.S. military[11][12][13] and U.S. territories including Puerto Rico and Guam.[14][15] Australia has also passed a law at the Commonwealth level that commenced on 1 September 2018.[16][17] The Australian states and territories of South Australia,[18][19] Victoria,[20] New South Wales,[21] the Australian Capital Territory,[22] the Northern Territory,[23] Queensland,[24] Western Australia,[25] and Tasmania,[26] have complementary state level laws that criminalize this behaviour. What if your ex-boyfriend posts a picture of you naked on Facebook without your permission? It is now a crime in the military. Article 117a, “Wrongful broadcast or distribution of intimate visual images” has been approved and now incorporated into the UCMJ. Article 117a states that:

Any person subject to this chapter who—
(1) knowingly and wrongfully broadcasts or distributes an intimate visual image of a private area of another person who—
(A) is at least 18 years of age at the time the intimate visual image was created;
(B) is identifiable from the image itself or from information displayed in connection with the image; and
(C) does not explicitly consent to the broadcast or distribution of the intimate visual image;
(2) knows or reasonably should have known that the intimate visual image was made under circumstances in which the person depicted in the intimate visual image retained a reasonable expectation of privacy regarding any broadcast or distribution of the intimate visual image; and
(3) knows or reasonably should have known that the broadcast or distribution of the intimate visual image is likely—
(A) to cause harm, harassment, intimidation, emotional distress, or financial loss for the person depicted in the intimate visual image; or
(B) to harm substantially the depicted person with respect to that person’s health, safety, business, calling, career, financial condition, reputation, or personal relationships, is guilty of wrongful distribution of intimate visual images and shall by punished as a court-martial may direct.

In more simple terms, this article makes it a crime to broadcast or distribute a picture of someone else’s private area if that person did not consent to it, or if that person has a good reason to believe it would be kept private, and if it could cause some type of harm. This article seems to address the exact scenario sometimes referred to as “revenge porn.” Now any military person taking revenge in that manner can be punished under the UCMJ. While this crime might have been punishable under Article 120c, it is now specifically delineated in Article 117a.

My stay in Ribera nm was traumatic and stressful. It feels like I have been taken hostage. Forced to take meds and be on ssi although I don't need those things. I wonder if my parents were offended I was in a relationship with an African American female. My sister though part Hispanic....Kara Feeley used to be a member of the el cajon kkk movement.
