False Police Report

I was just wondering if anyone knew what would be the outcome for filing a false police report against an individual? I know it's a class 1 misdemeanor and punishable up to 1 year in jail and $2500 in fines. If the person has a clean record, no driving record and military background with absolutely no run ins with the law, what would that person likely to get as a punishment?

Anyway, who knows but if jail time is a possibility I'd call a lawyer.

All I know is that anyone who knowingly files a false police report against someone who is innocent is a fucking head case and deserves whatever he or she gets.

I would be more worried about the charges going forward and being called to testify... perjury is probably a lot more serious and likely has a more serious penalty..

In my theory of justice, a person should get the maximum sentence for the crime they falsely accused the other person of. For example, falsely accuse someone of rape, you get charged, convicted and sentenced as if you had raped someone. And your record shows that you're a rapist and a liar.

unfortunately, this could be taken too far and make people afraid to file a police report, lest they be charged with the crime done against them.

But you did commit a crime. Making a false accusation is a crime.

I'm advocating having an 'adjustable rate' penalty for this crime.

The concept is: The more serious the false allegation is, the more serious the penalty. By falsely accusing someone of rape, you have put them in jeopardy of several years in prison. You shouldn't then be liable for only a misdemeanor. That seems out of balance, much like imprisoning someone in a basement dungeon for 8 years, and then only getting 6 months in jail for the crime.

Another example, If by your own choice you threaten to take someone's life from them (by falsely accusing capital murder, for example), you should also feel the burden of that threat as well. Your punishment should therefore take into consideration the severity of your lie, and the risk that lies like that have on the freedom of your victims and the justice system. That's just my theory anyway.

Well that is different than your original point, and yes I agree that aggravating factors should be taken into account when a person is sentenced.

At first he implied the accuser should be charged with a crime they did not commit. And then he said they should be punished according to the severity of their lie.

I still like the idea of them having the conviction of the crime they falsely accused another of being on their record permanently. Maybe you and I could work out some sort of compromise TheMeeper, in our new world. Perhaps the charge could be "Being no better than a (insert the false charge the person made against another)"

For example, "I see here on your CBI that you were convicted of being No Better Than A Murderer back in 1994"

Frankly, I'd prefer to see them get their ass thrown in jail for a few months and have to pay a huge fine, plus reimburse the police for all the time they wasted.
