A Virginia man was killed Sunday after a truck crossed over into his lane on Route 114, according to police.

Update 10:45 a.m., Monday: Police said Monday morning that a Virginia man was killed in a Sunday afternoon car crash on Route 114 after the driver of a pickup crossed into his lane, resulting in a head-on crash that sent three others to the hospital.

East Hampton Town Police identified the deceased as Douglas Foster Schneiderman, 51, of McLean, Va.

According to police, the driver of the pickup — 20-year-old East Hampton resident Brian Midgett, Jr. — was heading southbound on Route 114 when his 1996 Ford crossed over the double yellow line and hit Schneiderman's 2005 Volvo, which was also carrying two others. The two vehicles collided head-on and police said Schneiderman was pronounced dead at the scene.

Midgett was airlifted to Stony Brook University Medical Center with serious medical injuries, and Elisabeth Schneiderman, 51, was sent to Southampton Hospital along with 16-year-old Rachel Schneiderman with serious injuries.

Police are still investigating the crash, and both vehicles have been impounded for safety checks. Police are asking anyone who may have witnessed the crash to call 631-537-7575.

Update 9 p.m.: Route 114 re-opened shortly after 8 p.m. following a police investigation into a two-vehicle crash that killed at least one person early Sunday afternoon.

No further details were immediately available.

Original story: A two-car accident in East Hampton left one person dead on Sunday afternoon.

East Hampton Town Police Chief Ed Ecker said that Route 114 has been shut down, while detectives investigate the cause.

The accident occurred between Daniels Hole Road and South Breeze Road sometime before 12:45 p.m. The chief asked that motorists avoid Route 114 altogether until the road is reopened.

The chief said it was a head-on collision involving two vehicles. In addition to the person who died, a few others were injured, he said.

No other information was immediately available.

Several fire departments responded to the call.

Sunday's crash was the fifth fatal traffic-related crash in East Hampton this year.

Rt 114 has seen way too many fatalities and accidents over the years.In high school I remember the nickname "dead man's curve" being used to describe one particularly fatal area.

Police Still Investigating East Hampton Crash
A McLean man died in the accident on Long Island and another driver remains hospitalized one week and a half after the accident.

Exactly what caused the driver of a pick-up truck to cross into the oncoming lane on Route 114 in East Hampton, N.Y. on July 29, killing a McLean resident, is still under investigation.

East Hampton Town Police Detective Lt. Chris Anderson confirmed on Tuesday that no charges have been filed against Brian K. Midgett Jr., 20, of East Hampton.

Midgett remains hospitalized at Stony Brook University Medical Center, where he was airlifted after the crash. He is listed in good condition, according to the Department of Media Relations.

Anderson would not elaborate further on the ongoing investigation.

Douglas Foster Schneiderman, a 51-year-old developer from Mclean, was killed when Midgett's 1996 Ford pick-up truck hit his Volvo on Route 114, near South Breeze Drive, on July 29 just after 12:30 p.m.

Schneiderman and his family were visiting the South Fork on vacation.

His wife Elisabeth Schneiderman, also 51, and Rachael Schneiderman, 16, suffered serious injuries in the crash. According to Southampton Hospital records, they were released on Aug. 1, two days before their husband and father was laid to rest in Virginia.

He is also survived by another daughter Isabelle and step-daughter Victoria Kouri and her son Cameron Kouri, as well as his mother, Sandra Schneiderman, his father, Milton Schneiderman, his step-mother, Karen Schneiderman, and his sisters Lisa Penberthy, Abby Schneiderman and Jessica Schneiderman.

East Hampton, N.Y. police have filed a charge of driving under the influence of drugs against a New York driver involved in a head-on collision that killed McLean developer Douglas Schniederman last month. But Midgett's arraignment was postponed as the investigation continues.

Brian K. Midgett Jr. was scheduled to appear in East Hampton Town Justice Court on Thursday on a charge related to the head-on collision on Route 114 in East Hampton, which left the vice president of the McLean-based Madison Homes dead last month.

Midgett's attorney Susan Menu says there is currently no evidence against Midgett, 20, of East Hampton, N.Y.

Menu said police issued a desk appearance ticket — similar to a ticket drivers receive for a traffic violation — on the day of the crash for Midgett to appear on a DUI charge.

Menu said her client's blood tests were negative for alcohol. A toxicology report, which takes longer, she said, has not come back yet. His phone records have been subpoenaed, but the records have not been received, yet, she added.

"You can't arraign someone if you can't prove he did anything wrong," Menu said outside of court.

He has not been formally charged with a crime so far; his arraignment was adjourned until Oct. 4.

Menu made the application for the arraignment to be adjourned and the Suffolk County District Attorney's office complied. Robert Clifford, a spokesman for the DA's office, said Wednesday that "the Vehicular Crimes Unit investigation of the accident is not finished."

Police said that Midgett was behind the wheel of a pick-up truck that crossed into the opposite lane on Route 114 on July 29, hitting a Volvo SUV head-on at about 12:45 p.m.

On vacation with his family, Schneiderman, 51, of McLean, VA, was killed on impact.

His wife Elisabeth Schneiderman and 16-year-old daughter Rachel Schneiderman were hospitalized with serious injuries and released four days later.

Schneiderman had helped lead Madison Homes since its founding in 1992. They had a hand in building The Palladium in downtown McLean and The Reserve at Tysons Corner, according to its website. The company was also selected to develop Eleven Oaks in the City of Fairfax.

Route 114 remained closed for seven hours while police investigated the cause of the accident, but Midgett was not brought up on charges in the weeks that followed.

Midgett spent several weeks in Stony Brook University Hospital. He remains in a wheelchair, with two broken legs, and will require skin grafts, Menu said.

"If they were to find something in his system, it would be a pain killer," Menu said. "It's my hope, as his attorney, that this was just a terrible, tragic accident," she said. "He's devastated. His heart goes out to the family of the man who was killed."

Had there been evidence of a driving while intoxicated charge right after the accident, Midgett would have been arraigned in the hospital or in court right away, Menu said.
