Fairfax county parking ticket

So I got a parking ticket for and expired state inspection. I got the inspection done the same day and I was wondering if you can get the ticket dismissed in Fairfax county. Would I have to set a court date? Should I contact the parking officer that cited me and ask him to drop it? If I have to go to court do I have to pay court fees? That doesn't seem right because then there would be no point in contesting any tickets since they are usually not very much.

I know everyone will say that it's not worth the effort, but I live close to the court and have the time to try and get it dismissed. But I'm just wondering if the court fees make the appeals process useless.

any thoughts?

There's probably some variation from judge to judge, but you have a good chance of having it dismissed. I was a witness in a traffic case a while ago. While waiting for the case to be called, I saw a handful of people with expired inspection stickers and/or expired registrations get their cases dismissed by showing the judge that they'd promptly remedied the problem. I'm pretty sure they didn't pay court costs due to the dismissal.

One possible wrinkle here, though: these were traffic tickets, not parking tickets. I'm not sure whether they'd be handled differently in this case.

Yes. You will have to go through the motions of setting up a court date. Call the number on the back and have them send you the form to contest. Fill it out and sign it in blue ink. Take a pic of the new sticker showing your front plate. Print that pic and bring in the pink receipt from the inspection. Insure the sticker number on the windshield is easily read from the pic. When your name is called tell the judge you have a motion before trial. He/she will ask what that is. You will state that you have "complied with the law" by getting your car inspected. The judge may or may not ask for proof. This compliance with law phrase is in the statute of:

Its a ticket for parking a car with an expired state inspection (sticker) on a public highway. Its different from tickets that your would get if pulled over by a police officer (If I'm correct).

I would just present proof that I promptly remedied the problem, which sometimes leads to a dismissal. But I am wondering if it applies to parking tickets vs. traffic infractions.

Yea, I'm wondering if there is a difference since it's technically a different citation. Driving with an expired state inspection sticker vs. parking a vehicle with an expired inspection sticker on a public highway.

One question though. If the judge agrees to dismiss it, will the court fees be waived?

Maybe. There is no provision in the cited law that calls for waiver of a processing fee. Generally the whole charge is dismissed based on compliance of the law.

Seriously? Pay the $50 or whatever it is and save everybody some time and effort. If your time is worth so little that you would sacrifice a 1/2 day to get a minor infraction (of which you are guilty) dismissed, you'll probably turn it into a full day at the gov't center and get your food stamps and welfare all squared away while you are down there.

It's recorded against your record and thoroughly documented. Failure to pay may result in your Virginia driver's license being revoked.

My favorite thing to do is pulling people over and telling them their license is suspended because they failed to pay parking tickets, having their car towed, and taking them in custody and being booked in jail.

If you really want to gamble your entire career and lively hood on a measly parking ticket (remember, you received the ticket because you did something wrong), then be my guest.
