Citizens Arrest!!

Is this something I can really do? Friendz at work say to make citizen arrest. There ares all kinds o troublemakers where i live and i am aleays catching them being criminals. Police neva get there in time or catch them. Can i dos this legally in fairfax county virginias? Whats tha process? Can i shoot them or hit them? They r pretty big and tribal and always shoutin the curses and smoking.

I saw a guy tresspassing on my property so I ran at him, knocked him down and yelled "Citizens Arrest" at him. He started yelling and cursing at me so I hit him, broke his nose and knocked out some of his teeth. Police arrived and told me I did a good job. I also found out that when I jumped on him I broke one of his legs.

Police just told me to keep up the good work as I'm making their job much easier and cleaning up the streets too.

You run the risk of one of these so-called criminals doing something criminal to you, like stabbing or shooting you. Unless you have hard evidence that you acted in the prevention of a crime, you also put yourself out there for a myriad of criminal charges yourself. Assault, battery, unlawful detention, false arrest, kidnapping, etc.

My neighbor caught some teen loitering on the street in front of his house. He told the teen to move along, which the teen didn't do. My neighbor gave the teen another warning and nothing happened. So my neighbor yelled, "You're under Citizens Arrest" and grabbed the teens arm. The teen resisted so my neighbor twisted the teens arm behind the back, duc-taped hands together and put the teen in the trunk of his car. Then he called the Police who were very impressed and told him to have a good night. They took the teen to the Juveniles detention center for girls where her broken arm was treated and she was placed in a cell. He only had to testify to what happened and she was sentenced to 10 years so to answer your question Citizens arrests do get results.

Sure wish I could have seen my neighbor do that arrest but he only told me about it.

Video evidence of their crimes and willingness to testify at their trial will go a lot farther toward solving the problem and has a much, much lower risk of getting your ass kicked.

In Virginia, you are allowed to effect a citizens arrest only when you personally have witnessed someone committing a felony.

If you use force to effect your arrest, you'll likely be held to a very high standard of proof that your use of force was justified.

Here's an example.

You spot a teenager trespassing in your yard. You tuck your brand-new Kel-Tec PF-9 in your waistband and run out of your house to confront the person. You shout, "You're under citizen's arrest for trespassing!", to which the teen shouts, "Go fuck yourself!" and starts to walk away. You run up on the teenager and grab him, saying again, "You're under citizen's arrest!" The teenager punches you in the face, knocking you to the ground, and starts to run away. You reach into your waistband, pull out your gun, and shoot the teenager in the back.

When the police arrive, who will they arrest?

Agreed, you can't go around shooting people for non-violent crimes. Having said that, if someone breaks into you house, in Virginia, then you have every right to protect your home, family and self. If that means you shoot the guy because you were reasonably in fear for your life or the life of your family then so be it.

fyi, just because the person is on your property doesnt mean they can be arrested, not even by the cops. what measures have been taken to make sure its clear they are trespassing? is there a fence? sign posted? owner tell them to leave? even before the cops would arrest them, the owner would have to tell them to leave. then if they refused, they would be arrested if the victim/property owner was going to come to court. go ahead and pont your gun at someone on your property, you will likely be charged with brandishing no matter if its your property or not. thats why you pick up the phone and let the cops handle it. this entire post is stupid. any of you that would confront a criminal committing a felony is stupid. they might have a gun, knife, or whatever. is it really worth your life. let the cops handle the trash, thats what they are paid to do.

The common law in Virginia allows anyone to make a citizens arrest for a felony or if they witness a breach of the peace.

DON'T PERFORM A CITIZEN'S ARREST. You do not have qualified immunity, as the police do, so you can be held liable criminally and civilly if the defendant is found not guilty, charges are reduced, or dropped. Even if he is found guilty, he can still pursue charges criminally and civilly against you if he can convince a magistrate that you did something improper. You would not be able to afford the cost of defending this kind of litigation.

Of course, Good Samaritan laws are different and do not apply here, as well as any offense that is putting you or a third party in serious physical danger.
