got pulled over by a cop for passing a pulled over car from the left.

Hey Guys here is an interesting case. A couple of days ago I was driving on Frying pan road (Fairfax county-Herndon). IF you have ever taken an exit from 28 onto FP road in the evenings (5-6pm) you might be aware of the traffic due to its single lane. So a couple of days go I was in that traffic and moving towards centreville road ( I had to make a left there). As i mentioned the FPan Road is single lane and it expands later on into two only left lanes for those who want to take left on centreville road. So after following the single lane traffic i approached the expansion for only left.I merged there and I stood behind a BMV car whose hazard lights were ON (I didnt recognize the car was stuck while I was coming from the traffic). The BMV car was standing right in between so if I had to take the left I had only two options .. go from the left of the car or or from the right where it was packed with all the single lane traffic who wanted to go straight. Once I saw no vehicles on my left I passed the BMV car from the left (in doing so I did cross the double yellow lines) and came back to my lane. All of a sudden a cop comes running from the extreme right corner of the road and shouts at me to back off and stay there. The cop had kept his motor cycle on the extreme right corner of the road and now i realize that also the BMW that was standing on the middle of the road was a pulled over car by him... which he wasnt attending when I crossed, that is why I never realized there is a cop around.

Ultimately I got a ticket for crossing double yellow line. All those after me who wanted to take a left had to go all the way to the front and then shift left.. coz there was no place.

Although I did commit a mistake ... I somehow feel I reacted to a situation (created by the cop) rather than purposely violating a rule. This is the first time Im getting a ticket.. so im unware if it was right on the part of the cop to pull over that BMW car on the middle of the road? and usually whenever a cop pulls over a car I have usually seen the cop right behind the car.. in this case he near his motorcycle.. on the right corner of the road..

If you have any inputs let know.. SHould I take this to court? or just pay the fine?

Pay the darn ticket and move on with your life.

When I moved around the car I did not know its a pulled over car because the cop was not visible. It looked more like the car broke down

BOTTOM LINE IN THIS CASE IS YOU WERE TICKETED IN FAIRFAX COUNTY AND THAT MEANS ONLY ONE THING...............

YOU ARE FRIGGIN GUILTY NO MATTER HOW MUCH COMMON SENSE YOU APPLIED!!!!!

Two options:

1. As said above, "Pay the darn ticket and move on with your life."

2. Take the day off from work, go to Fairfax courthouse, get in line for parking (which costs $2 per hour), wait in a security line (hand in your phone), find your courtroom, wait until your case is called, explain to the judge exactly as you explained it to us, hear the judge say "Guilty," watch the judge ask the officer if you have a record, and then you can pay your ticket.

Thanks a lot for your prompt replies. Just one question does the insurance rate also go up for such violations? Looking at the DMV website I think I might be ending up with 3 points and $92 fine.

Chew on this, O.P. - If you didnt see the cop then it's possible you would have missed a pedestrian or an oncoming car, for all we know.................

It doesn't matter why a vehicle is blocking the road, unless you are being directed around it by an officer you NEVER CROSS THE DOUBLE YELLOW! EVER!

I always go to court on every ticket. Usually the judge will dismiss the ticket or reduce some part of it.

The biggest part is the hassle of waiting around half the day in court.

little did he mention, he was on his cell phone and thats why he didnt see the cop. just another ffx county idiot, driving with his head up his ass thinking they own the road.

Your reaction to the situation "(created by the cop)" was wrong regardless. You should have waited and tried to merge into the right lane to continue. The cop's bike was all the way to the right side because of drivers like you. He must have been in a decent mood. You're lucky you just got a ticket from him for crossing the double yellow. You'll probably piss off the judge going to court with this unless you got a reckless charge and then you'd have to go but it doesn't sound as if you got that. Live and learn.

I would go to court and fight it. The cop was the cause of the incident. As long as we have cops with fat bellies and GED's, this will always happen. Fight it in court. The judge is educated and will take you side with just a small fine.

This is the best advice yet. Go to court and tell the judge it was the cops fault. Little known fact, if you argue in court that it is the cops fault the judge will dismiss the case. OJ got off and he used that defense (more or less). Just let us all know when your court date is please..
