I was in an accident (caused by the other person) and submitted a claim to the other person's insurance company. They came back to me in writing offering to settle for the value of the person's policy. Let's say this is $50K
Question
1. Would it be reasonable to expect to find a personal injury lawyer who would take this on contingency for the amount OVER what I've already been offered?
2. Since this is a relatively straightforward case, (the insurance company already offered to settle) what contingency rate would be appropriate? 30% 33% 40%
3. Does anyone have any expereince with any personal injury attornies in Fairfax county?

Unless the defendant is loaded, unlikely if he only has $50k in liability insurance, the easy and sometimes the only way to collect on any judgment is from the other guy's insurance. You take that off the table and the personal injury attorney is taking a huge risk that he will do alot of work and not get paid for it. For that much risk the attorney is probably going to want to be paid far more than the typical rates, if they will touch the case at all. 30-40% are the normal rates. If you can find a PI attorney who will work on your terms the percentages are likely to be higher.
