Husband of Bobbie Bosworth, Springfield Mall abduction victim, settles suit for $2.5 million

The lawsuit by the husband of Bobbie Bosworth, who was abducted from Springfield Mall in 2008 and killed, was settled shortly before trial in June. Now, the amount of the settlement has been finalized: $2.5 million, to be paid by the owners of Springfield Mall and their insurers, and by the Woodbridge mini-mart where Bosworth was taken by her teenage abductors, one of whom also died in a subsequent car crash.
Tom Bosworth of Alexandria, Bobbie Bosworth’s husband of 24 years, filed suit in 2010 against Vornado Realty Trust, the owner of Springfield Mall; Securitas Corp., the company hired to guard the mall; and the owners of the PDQ Mini Mart, alleging that all three had a “duty of care” to their customers, and that Springfield Mall in particular allowed an “assaultive” climate to dominate the now-closed mall.
Securitas was dismissed from the case because it was not the owner and did not have a “special relationship” with the customers. But Vornado and PDQ could not get out, and so settled on the eve of trial.
According to court documents filed recently in Fairfax County Circuit Court, Vornado paid $2 million: $1.4 million from three different insurance companies, and $600,000 from Vornado itself. The PDQ Mart paid $500,000. In addition, State Farm, the Bosworth’s auto insurer, paid $100,000 in an earlier settlement, court records show.
The settlement amount was first reported by Virginia Lawyers Weekly.
