I call BS. What was the charge and reason for the arrest? Why did they show up to begin with? Did this just happen, if not, when was the arrest?

The Cop was a jerk. I was quoting Commonwealth Law but he was quoting County Law for Eviction of a 20 year old with no Rental or Lease Agreement.

Sounds like you were drunk and brought a lot of drama on yourself. Quoting Commonwealth Law is not helpful; especially since if you know Commonwealth Law so well, you know that ANYONE living under your roof; rental agreement, lease agreement, etc., has to go through the eviction process. This is a civil issue and one that the cops can't help you on. Thus, you have no case and just made more trouble for yourself than it was worth.

Good thing is once you move from FFX cops won't seem that bad anymore.

good luck fighting that. doesnt matter if you think you werent drunk. drunk in public law says you only have to have the appearance of being intoxicated. you can be arrested for being high on drugs or scripts, and still be arrested for that. hire an attourney. that way you can still lose the case, and have to pay big money to an attourney. best advice, stay inside when your drinking. and if you go outside, dont act like an ass and tell the cop how to do his job when your dumb enough to flag him down.

If I go to a Jury, it is the Police that MUST PROVE I was drunk. I wasn't.

We had a very long thread on this very subject here . I quoted the law on what constitutes private and public spaces and the law that would pertain to drinking in your front yard where any member of the public could see or stumble on or has access to your property i.e. no fence, doorman/security guard etc to prevent that).

While I still stand by my argument that drinking in your front yard or being drunk in your front yard or drinking in the parking lot of Jiffy Lube Live is a public space (or place. Some states use "public spaces", some use "public places". I use these interchangeably because they are and it gets less confusing) and it is illegal to be drinking/drunk in a public space no matter who owns the property. Some of the the legal eagles here at FairfaxUnderground disagreed with me and stated the law of the land does not apply to private property. I was arguing public and private spaces, they were arguing public and private property.

So while you and I have an understanding of what public and private spaces are, it is still a controversial subject here at FXU where many believe you can sit on a lawn chair in your front yard near a road, drink several beers and flip the bird to passing cops because your front yard is you private property and not a public space.

If only the courts would weigh in this with a similar case we could clear up this controversial matter here at Fairfaxunderground.

you wont win it in court. all the cops have to say is you had the appearence of being intoxicated. odor of alcohol, slurred speach, unsteady on your feet, dialated or red pupils, all of the above or even just one or two will do in court. just pay the $100 ticket and next time call the cops to your house and stay inside. if your drinking, dont go outside.

drunk in public doesnt matter if you are on private or public property. if you can be seen from public property and you are on private property, you can be arrested. you wont be arrested if you are inside your home, but on the back porch in plain view of the public, you can be arrested. this guy prob wouldnt have been arrested if he didnt preach va law to the cop. they dont like that, and he should of handled his daughter/daddy issue in civil court thru the eviction process. he wont say what he really said to the cop, but im sure he was acting like a drunk idiot and that doesnt work out well either. by the way, you can also be arrested for dip if you are a passenger in a vehicle. especially if the driver gets arrested for dwi by the cops. the only place you can be sure not to get arrested, is inside your home.

for a drunk in public conviction, you do not have to actually be intoxicated. If you read the code, it says APPEAR intoxicated (bloodshot glassy red eyes, slurred speech, the odor of an alcoholic beverage emanating from your person, unsteady gait). Unlike driving under the influence where proof must be furnished that you are actually intoxicated, for DIP the Officer just needs to testify to the above listed descriptions of the subject at the time of the arrest. Here is a tip: if you are drinking, do not argue and be loud with the police, as you can have 2 beers and appear DIP. its a pre payable $100 fine and doesn't even appear on a criminal history, just take your pinch

The Cop got PO'd because I wanted my daughter out for the night, and I quoted the VA LIS Law -- He quoted the county Law.

He stated to the Magistrate that I argued with him, so he arrested me.

The Cop said he was arresting "for drunk in Public", not intoxication, "DRUNK", yet they have no proof.

Eviction is a CIVIL process the cops have no authority over. County Police can NOT evict. Thats the Sheriffs Office. Call them.

Proof? What kind of proof could they have? The same "proof" someone someone ran a red light? Its his/hers observations and how its articulated in court.

Pay the freakin ticket or hire an attorney, so it can cost you much more.
