Alcohol Purchase Identification Rules

Hey all, I was wondering if anyone can help me understand why, when I go to a store an buy alcohol, if I have another person with me, that person also gets ID'd...

Can someone point to a law that says stores must do this? Or are local stores just overprotecting themselves from liability? I have found that some stores do and some don't, and this uneven enforcement is bullshit.....

If the clerk sees an exchange of money, the clerk can ask for both ID's. For example you get to the counter and a buddy hands you a five or ten to pitch in for the beer. Other than that I don't see a law that says all people around you have to be carded.

Perhaps it falls under contributing to the delinquency of a minor, but even then every Mom who buys a bottle of wine with her kid present in line would be in the same boat.

I was at Wegmans just after the gym with my girlfriend. We ran in to get a few things for dinner and a bottle of wine. I'm 31 and she is 26; i grabbed my wallet and she came allong without an id. The cashier ask for both of our ids and I explained that I was purchasing the wine and my GF didnt have an ID on her. They tried to refuse and I demanded a manager.... the mgr after a firm scalding gave in. PERIOD! eff'em. Bullshit all over it.

had a similar experience at safeway with my roommate on superbowl sunday. she's 25, i'm 22. the cashier saw us talking to each other (she was buying beer and snacks, i was buying a frozen pizza) and tried to ID both of us, i told her i wasn't "with" her and that she couldn't ID me. she said the safeway people tell them to do that..i think she's just a tool.

the west ox rd safeway is full of ballbusters when it comes to ID for tobacco, alcohol, etc. i understand they're just doing their job, but gimme a break.

It's an age restricted item. The merchants reserve the right to refuse a sale to anyone for any reason. If they get caught selling to an underaged person the ABC board may revoke their ABC permit for a while and levy a fine, both of which are very costly to them. This is something that they would rather not deal with.

There are three basic ways to deal with this:

* Either make sure everyone on your group has their ID when purchasing an age restricted item

* Shop somewhere else

* Drink water

There is no law that says we MUST do it. There are, however, laws which state we cannot serve or sell alcohol to persons under 21 years of age. We have an obligation to obey the law and an obligation to protect ourselves. That means we must ID people, whether they like it or not. The ABC board and local law enforcement agencies conduct stings all the time. If we sell to someone under age we open ourselves up to criminal prosecution (for the person who sold the age restricted item) and civil penalties in the form of fines and ABC license suspension. Why can't you understand that?

Here's another interesting question. Why is it you can go to Giant/Safeway/Etc and buy "cooking wine" that's like 14% alcohol, but there's no ID check.

If the person buying the alcohol is 21 or over, why does a cashier need to card any person other than the purchaser? That's the VA law we are looking for and can't find.

I had this same thing happen happen at a drugstore in New Orleans. And they seem way too lax about alcohol.
