So my neighbors have set up a video camera that is positioned to show my front yard and parking spots. What can I do? How do I get them to remove it? What can I do legally?

Why did that do it? Do you have a lot of disputes with them? Are you parking too many cars in the street or your yard that has got them upset? I'm pretty sure it wasn't random, so what is the problem between you are your neighbors?

There is absoluteness nothing at all that you can do to stop them from videotaping from their own property. I guess legally you could put up a fence and that could stop them from filming beyond the fence. Then again that could be against HOA rules and while not technically the law, Id probably rather kick a cop in the crotch than piss off your HOA.

Why dont you set one up and videotape them?

Hmmm, interesting. I have a neighbor down the street from me who installed a video camera directly over their front door because of issues with their next door neighbor.

I wonder, if wondergirl is that next door neighbor. If she is then she better be glad that more neighbors haven't done the same thing.

This neighbor is a nightmare. We never had a police pressence in our neighborhood until they moved in. Since then, the police are there all the time.

On weekend we came home to find our street blocked off and a total of 17 police cars in our neighborhood and on the main road, setting up a perimeter in hopes of catching three people associated with her son.

If it's not you wondergirl, then I apologize. If it is you, then just know, he's not the only neighbor watching you!

I have security cameras all around the house in every direction. Some kid messed with one of my cars once and I gave the video to the police. The police tracked the guy down in two days and charged him.

I suggest everybody puts up video cameras to catch people f'n with your stuff.

There's an elderly woman in my neighborhood who has a camera installed in the bay window of her kitchen so if someone knocks on her door she can see who it is without climbing the stairs. So what if she can see her neighbors houses too?

Well I call the cops on them about 2-3 a month for noise violations. The camera is inside the house on the front window aiming toward my yard and parking spots. We never park in their spots nor do we make noise. I wonder if they have illegal
activities going on in the house and this is a way for them to see the cops coming first.

I just hate knowing that my digging in my yard might be post on youtube or something somewhere....:(

I suggest that you track in a personal log the dates, times, times of the day, vehicles (makes of their cars, get license plates numbers, letters) if you can. I have some cameras but I don't have them setup on the exterior. As long as one of us is home, the dogs always keeps us alert to anything going on around the house. When some asshole was making attempts to vandalize my car one time, I just situated my dog's kennel cage in the part of the house facing the cars, and it worked.

As for the camera facing your own home, I do think you could have a case against them if it was directed to look into your windows. A general area camera should be legit, though. I have a trail camera that picked up my neighbor's kids playing in the next door yard one day, and I actually had a pic of their mom checking it out, lol. The lady never asked any questions, but then one day they had their landscaper cut down a tree on our property, and it was the main tree that I used for my camera (It faced a very large tree that had a lot of activity at night). I didn't think that was very cool, so I put the camera on my deck the next time (Try cutting that down).

@Wondergirl1: You still haven't answered some basic questions being asked of you here.

1) Do you think this camera was installed specifically to watch you or does your house just so happen to be in the line of sight of the camera? (along with the actual intended object of surveillance)

2) Have you openly had any issues with your neighbor in the past? (ie, they KNOW you called the cops on them.)

You might not have been the reason that they installed those cameras. Have you considered that as a possibility?

I put cameras in last year after some cars were vandalized in the neighborhood. I tried to cover my front and back doors and driveway. If I stood in the street or on my neighbor's driveway I'm sure at least one of them looks like it's pointing that way, but after 50 or 100 feet, you really can't see anything. At night, you can see in the areas illuminated by outdoor lights - after that, nothing, and that's with an IR flood light on the camera. Chances are 1) they aren't pointed at you, but at their property, and 2) they can't see shit anyway. Unless it's HD with Pan-Tilt-Zoom functionality and IR (meaning $$$$$), even if they wanted to spy on you, they can't.

If the camera is filming primarily their property and yours just happens to be in "line of sight" there is nothing you can do. HOWEVER, my neighbor put up a security light/ camera system on the EDGE of his privacy fence. The Sensor and the camera lens do not point at his property at all but instead point at my car port and the back of my house. (I've had issues before with this neighbor. He's a registered pedophile and he has come on my property with a hidden camera before. When I told him to get off the property he charged after me on my own porch. I took out my shotgun and ordered him off my land. When the police arrived they arrested ME. The
charges were "aggravated assault with a deadly weapon (firearm). Our State has a "stand your ground" law so the charges will eventually be dismissed). At any rate, I have a 12 year old son and this man is a pedophile, the fact that he now has a camera pointed directly at my house for the soul purpose of monitoring nothing else but my house is a clear case of electronic voyeurism. I will be filing charges next week.

Videotaping and Photography on Private Property

Sometimes, whether a photograph or videotape was legally taken depends on the location where it was taken, and the photographer's status to be on that property. Generally, the public has an implied right to be on the public portions of private property, such as in a restaurant or a stadium. However, that implied right does not extend to private areas of public accommodations, such as offices or the hallways of condominium buildings. It depends on the situation and the social expectation. If you think that you're getting away with something, then you probably are, at least until you're discovered.

Public Access
Sometimes, it may seem that the public has been given access to private property, especially when public use of the property is traditional. Examples of this are wilderness areas, hiking trails, swimming areas or access areas to a beach. If you make a mistake, you still may be in trouble, regardless of your belief that your access complied with the law. Don't depend on the lack of signs. In most places people are not required to post their land with no trespassing signs.

Things you should know about trespass:

•Extending a camera over a fence may be a trespass
•Flying over a property for the purpose of taking photos may be a trespass
•"No Trespassing" signs are not required
•If you have permission, don't abuse the permission
Exceptions to ordinary trespass laws:

•Taking photographs to document or lessen a disaster
•Taking photographs to document a crime
•You may take photographs or shoot video from your own property, onto private property
•You have permission to be on the property for other purposes
What to Do
The factors above are great to consider, but the answer to the question of whether or not you were trespassing is fact driven. That simply means that all the facts relative to your legal status on the property may be considered if the property owner files a complaint against you. The key is to use your common sense and err on the side of not trespassing.

An interesting case involves a private road, and a photograph shot of the private road sign, while standing on the private road. The property owner is seeking money damages for an invasion of privacy. It's all over the internet now and the public can see the private road sign for themselves. This area of law is ever-changing because of the availability of cheap and easy-to-use digital cameras. In this modern era, nearly everybody is a photographer or videographer, and the issue could affect you.

Nuisance
There is something in the law called a nuisance. In terms of photography and videotape, a nuisance is some activity that interferes with a property owner's reasonable use of his or her own property. It is difficult for a property owner to prevail in a nuisance action against a photographer or videographer because it is difficult to meet the legal burden needed to prove a claim. The annoyance to the property owner needs to be very real, and not just the result of the property owner's hypersensitivity or subjectivity. Take wildlife photos on your own land, even if the neighbors are animal rights activists, but don't take photos of nude models in your front yard.

I live in a duplex and both units rent i live upstairs and them downstairs they are recording my kids (minors) and there friends also minors none of the parents like it . I have called police but they dont know the law n allow them to record myself and 3 other families would like to sue them but dont know how to go about it. any suggestions we r in wis.

I have the same problem. The older lady at the end of my street snaps pictures and records the kids in the neighborhood riding bikes or standing in the road

Tell them the video camera makes you nervous and ask them to put it some place where you can't see it taping you.

On an average day a normal person is video taped about 20 times. You just don't realize it's going on.

1) Almost all condo and housing complexes have at least four security cams in them. Just because you can see the neighbors cam doesn't mean there aren't more hidden cam pointed at the lot from other places.
2) Traffic cams are every where around this area.
3) Buses and public transportation have hidden cams.
4) Gas stations and stores are loaded with cams.
5) All the major buildings in the area have a security cam at the main entrance.
6) A lot of people now mount dash cams in the their cars and trucks.
7) Bars and restaurants are loaded with security cams.

The difference here though is that the OP is on their private property, an entirely different situation than being out in public.

The camera's could be the width of a hair, and nearly impossible to find the electronic bugs in the bedroom or bathroom.

Most hotels in vegas have these types of bugs in there guest rooms when their laides (use the term lightly) are making money for them.

Some solutions. Have sex with the television on, and in the dark with the volume up so if the neighbors are lisiting, all they will hear is music or some show on t.v.

Learn to do stuff in low light when going to the bathroom, and bedroom.

If your room in bug free, make sure the curtians are closed, and check if you can see through your own window at night with the lights on. If you can see, so can your peeping tom neighbors.

Motion dectors are another option to consider.

Wireless, and cell phones are something to be carefull with also.

Going to the bathroom in a public restroom? Turn out the lights if possible, and don't stay too long on the toilet. Always assume there is a hidden camera spying on you, and keep it fast, and out of there.

I would say supersoaker (muzzle velocity of 50'/sec.) with a mix of water and veg oil ( you could experiment with various water soluble solutions such as water-based lacquer) . Go out with your kids and play like you are aiming at each other while coating the lenses with your oily mix. You could do this weekly to keep the lenses unusable.

If you go the supersoaker route make sure to pick up some IR LED's and tape them to a hat and wear it. Then proceed with the mission under cover of darkness. If the cameras have night vision (Infra Red) capability, overloading them with your IR LEDs will render you unidentifiable.

If you listen to anyone here who tells you to damage the cameras then you are truly not very wise. You will be guilty of a crime and since you cannot say with 100% certainty that you know where all of the cameras are, is it really worth paying for damages as well as being known as the neighborhood vandal?

Why not just speak nicely to your neighbors and request that they take them down or move them (this means no cursing, finger pointing, rude comments)? Most of us were taught that route as children and realized as adults that it really does get us what we want more often than not.

A little polite behavior on this one just might get you the results you say you want.

My neighbors moved camera, upon request. I wish I would have pretended to kill some one, drag them into house, fire up electric chainsaw and then carry 2 heavy trash bags to trunk, dripping chicken blood down sidewalk. They are not spying on you.
I have 4 cameras in front of my house setup to overlap areas of coverage which includes the street. So that means they crisscross each others views and will pick up views past my houses and partially down the street. You should be grateful they do see your driveway. The reason being if something happens to your vehicles they may record it. I caught kids stealing mail from my neighbors mailbox. He used that to get to his mail delivery moved to a slot in his garage instead of a box. Unless the cameras are very hi end they really can't see much past 30 to 40 feet cleary. If vandals see cameras pointed at areas they may not do anything at all. I do angle my cameras so they don't see much above the ground level general about the height of the roof of a car in the street. They are more for catching things happening on my property and around my vehicles.
Just ask them what the cameras sees. Mine sees my neighbors driveway only because it is next to mine.

I am against a security camera being pointed off of the protected property onto someone elses,however i see a technical error in your apparent assumption above. A camera extends nothing into the private property. Technically,the image(as light) goes onto the property where the camera is and the camera simply captures it. A right to remove the camera as you sugest could get you,in a whole bunch of trouble.A whole lot cheaper to pay an attorney for advice.

Unless their cameras are high tech they have a limited range. Meaning that they are probably lucky to get a clear view of their own front yard much less the yard across the street from them.

What makes you think that they are purposely and specifically recording YOU? If they seem like otherwise reasonable people I would ask them about their cameras. They must be pretty obvious for you to be noticing them like that. But in reality - LOTS of people have them because they aren't all that expensive and certainly they are a lot cheaper than having your car broke into or your mail stolen or worse...

We had a news story recently about a camera that wasn't even real. It was a 9.99 dummy camera and the person having a fit about it wasn't being filmed at all. First world problems people.

I don't think that I am all that interesting to watch. But weirdos are...weird. If they have a camera aimed into my window or over my fence and into my backyard - that is weird wouldn't you say? Actually it would be weird for them to be purposely videotaping MY property or ME at all.

I'm not going to ASSume they are doing that. But if it is pretty darned obvious that that is what they are doing - yeah, I wouldn't appreciate some weirdo videotaping me.

Maybe if the neighbors kept their kids off the other neighbors property there would not be such a problem A camera is a great way to document the action and resulting damages when the kids are kicking soccer balls through your windows from you back yard that they are not supposed to be trespassing on.
