So let me get this straight...

Very simple question that people are going to be annoyed by because it probably has been answered here many times.

How fast do you have to be going over the speed limit in Va to get a reckless driving ticket?

That is what I thought, but the other day I got a ticket for going 83 in a 65 and the cop said that was wreckless driving, but he let me go with a speeding ticket. He even dropped the 83 to an 80 on the ticket to make it look like a speeding intstead of a wreckless.

Reckless is 20 over OR over 80.

Cop cut you a break!

You guys are both idiots...BTW you can get a reckless even if your are not speeding. Case in point: That idiot who hit the accelerator instead of the brake and drove into the DMV the other day.

dee dee dee is correct. You can get reckless for driving like an idiot. You could be speeding, or not. But 20 over the speed limit lets them give you a reckless even if you were driving carefully and not weaving through traffic, like if you were on a deserted highway at 2 in the morning, not that that is possible around here anymore.

It's entirely up to the cop's discretion.

Lots of stuff comes under the reckless driving statute besides speeding.

I think even passing a school bus is reckless.

20MPH over is not AUTOMATIC reckless

I got caught on 495 going 23 miles over, and the cop gave me a ticket, 73 in a 55.

This was also a Fairfax County Cop. I think he let me off the hook, because he was stationary running radar, and i must have stopped a quarter to 1/2 mile away, and backed up all the way to him. So he didn't have to walk.

It's up to the cop's discretion. He can give you one even if you are not speeding, but are driving erratically, for example.
